Abstract:
The purpose of this research is to study the concept of offenses against human life according to the principles of the Criminal Code, Section 293, and the principles of the Dhamma and Vinaya regarding the Third Parajikan in Buddhism. To study the law related to inciting others to commit suicide according to Section 293 of the Criminal Code and the principles of the Dharma and Vinaya regarding the Third Parajikan. To study and analyze the comparison of inciting others to commit suicide according to the principles of the Criminal Code, Section 293, with the principles of the Dhamma and Vinaya regarding the Third Parajikan in Buddhism and related foreign laws. To provide guidelines and suggestions for improving and amending the Criminal Code, Section 293, by applying Buddhist principles to be beneficial and appropriate for the present era.
The research results found that The impact of inciting others to commit suicide in legal and religious contexts. The study found that Section 293 of the Criminal Law stipulates that those who instigate or assist in suicide must be punished. Even if the instigator doesn't die. While the principles of Dhamma and Vinaya provide the highest punishment in cases of incitement or description of death. which caused the monks to be paralyzed. This reflects the focus of criminal law on the protection of life in terms of outcomes. But the main principles in the Dhamma and Vinaya focus on preventing actions that are contrary to morality from the beginning. And the social and psychological effects of victims of incitement should be studied. To develop future remedies and prevention processes.
Suggestions from the research are: There should be in-depth research on the methods of enforcing laws in foreign countries that are similar to Section 293 in order to develop Thai laws to be more effective. In addition, Buddhist principles should be integrated with Thai criminal law to serve as an effective guideline for preventing incitement to suicide. Using the principles of kindness and non-violence. This is the principle that focuses on prevention and building mental immunity for the people. More than just criminal punishment, it is used to improve the criminal legal system to better deal with cases of incitement to suicide.
