Abstract: การศึกษาวิจัยเรื่อง “การศึกษาเปรียบเทียบระบบการควบคุมบทบัญญัติแห่งกฎหมาย มิให้ขัดหรือแย้งต่อรัฐธรรมนูญของสาธารณรัฐฝรั่งเศสและราชอาณาจักรไทย” โดยมีวัตถุประสงค์ ดังนี้ (1) เพื่อศึกษาถึงแนวคิดเกี่ยวกับหลักความชอบด้วยรัฐธรรมนูญของกฎหมาย (2) เพื่อศึกษาถึงความเป็นมาและความสำคัญของศาลรัฐธรรมนูญของราชอาณาจักรไทยและคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศส (3) เพื่อศึกษาถึงบทบัญญัติของรัฐธรรมนูญและกฎหมายที่เกี่ยวข้องกับโครงสร้าง อำนาจหน้าที่และกระบวนการพิจารณาของคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศสและศาลรัฐธรรมนูญของราชอาณาจักรไทย (4) เพื่อให้ได้มาซึ่งข้อเสนอแนะการปรับปรุงถึงโครงสร้าง อำนาจหน้าที่และกระบวนการพิจารณาที่มีความเหมาะสมกับศาลรัฐธรรมนูญของราชอาณาจักรไทย สารนิพนธ์ฉบับนี้มุ่งศึกษารัฐธรรมนูญและกฎหมายที่เกี่ยวข้องกับคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศสและศาลรัฐธรรมนูญของราชอาณาจักรไทย โดยศึกษาถึงที่มา โครงสร้าง อำนาจหน้าที่และผลของคำวินิจฉัยของคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศสและศาลรัฐธรรมนูญของราชอาณาจักรไทย การจัดทำสารนิพนธ์ฉบับนี้ได้จัดทำในรูปแบบการศึกษาทางเอกสาร (Documentary Research) โดยศึกษาจากรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 และรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2560 หนังสือ ตำรา วิทยานิพนธ์ที่เกี่ยวข้อง บทความที่เกี่ยวข้อง รวมถึงศึกษาจากสื่อออนไลน์ที่เกี่ยวข้องด้วย ผลการวิจัย พบว่า ภารกิจในการควบคุมกฎหมายมิให้ขัดต่อรัฐธรรมนูญของศาลรัฐธรรมนูญของราชอาณาจักรไทยมีความคล้ายคลึงและมีความแตกต่างกันอยู่ในบางประการกับคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศส กับทั้งมีกลไกและวิธีการบางอย่างที่ศาลรัฐธรรมนูญของราชอาณาจักรไทยสามารถนำมาประยุกต์ใช้ได้ ซึ่งผู้วิจัยได้จัดทำข้อเสนอแนะที่สามารถนำมาปรับใช้ได้กับศาลรัฐธรรมนูญของราชอาณาจักรไทยโดยมีการแก้ไขรัฐธรรมนูญหรือกฎหมายอื่นๆ ในบางประการ ข้อเสนอแนะ ผู้วิจัยเห็นว่าควรแก้ไขเพิ่มเติมรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 มาตรา 148 ดังนี้ - เพิ่มมาตรา 148 วรรค 2 โดยใช้ถ้อยคำดังต่อไปนี้ “เมื่อศาลรัฐธรรมนูญได้รับความเห็นว่าร่างพระราชบัญญัติมีความขัดหรือแย้งต่อรัฐธรรมนูญหรือตราขึ้นโดยไม่ถูกต้องตามบทบัญญัติแห่งรัฐธรรมนูญตามมาตรา 148 วรรคแรก (1) หรือ (2) ให้ศาลรัฐธรรมนูญพิจารณาให้แล้วเสร็จภายในหนึ่งเดือน” เหตุผลของการเพิ่มเติมมาตรา 148 วรรค 2 เพราะผู้วิจัยเห็นว่า มาตรา 148 นั้น ไม่มีการกำหนดระยะเวลาของการพิจารณาความชอบด้วยรัฐธรรมนูญของร่างพระราชบัญญัติไว้แต่อย่างใด ผู้วิจัยจึงต้องการให้ร่างพระราชบัญญัติที่ผ่านความเห็นชอบของรัฐสภาแล้วนั้นว่าหากมีบทบัญญัติใดที่ต้องให้ศาลรัฐธรรมนูญพิจารณา ศาลรัฐธรรมนูญต้องพิจารณาให้แล้วเสร็จภายในหนึ่งเดือน ซึ่งจะทำให้ร่างพระราชบัญญัตินั้นจะได้มีผลบังคับใช้ในเวลาที่ไม่นานเกินไป จะได้สอดคล้องกับความต้องการในการแก้ไขปัญหาของประเทศในเรื่องนั้นๆ ได้อย่างรวดเร็ว ทันต่อเหตุการณ์ เช่นเดียวกับกระบวนการพิจารณาของคณะตุลาการรัฐธรรมนูญของสาธารณรัฐฝรั่งเศส ซึ่งก็กำหนดระยะเวลาในการพิจารณาความชอบด้วยรัฐธรรมนูญของกฎหมายโดยคณะตุลาการรัฐธรรมนูญภายในระยะเวลาหนึ่งเดือนเช่นกัน

Abstract: The research entitled as “A Comparative Study of the System of Controlling the Provisions of any law not Contrary to or Inconsistent with the Constitution of France Republic and The Kingdom of Thailand” has the objectives as follows : (1) to study the concept about the right of constitutional law, (2) to study the background and significance of the Constitution of France Republic and The Kingdom of Thailand, (3) to study the rule of constitution and laws about the structure, power, duty and judgment procedure of constitution committee of the Constitution of France Republic and The Kingdom of Thailand, (4) to receive the suggestions about the structure improvement, power, duty and judgment procedure of constitution committee of the Constitution of France Republic and The Kingdom of Thailand. The findings of the research found that the missions of Controlling the Provisions of any law not Contrary to or Inconsistent with the Constitution of France Republic and The Kingdom of Thailand are similar and different aspects and constitutional tribunal of France Republic has the mechanism and method the constitutional court of Thailand can be applied. A researcher has the suggestions which can be applied to the constitutional court of the Kingdom of Thailand by the constitutional amendment and other laws’ changes. The suggestions as mentioned above such as the constitutional amendment of the Kingdom of Thailand 2560 B.E. by sharing the jury committee into two or three of constitutional court that the first jury committee has the duty to consider the problem of the right due to the constitutional court and the second jury committee has the duty to consider about the other political problems which mentions along with the constitutional court 2561 B.E. , has the change of judgment to be as the consideration of general Judiciary judgment to be used in all cases and the special judiciary judgement as the rule to use in each case. When it has the new organization management and classify the judiciary judgement, it is necessary to recruit the personnel to be the experts in the organization that all suggestions for the constitutional court can do it by changing the constitution or the related Acts to the constitution toward the judiciary judgment such as to set up the numbers of jury etc. that the researcher believes that the all suggestions are useful to the works procedure of the constitutional court in the future
