The Efficiency Increasing of Mediation at The Investigation Level According to The Mediation Act B.E. 2562: The Study of The Provincial Police Stations in Phayao Province
Abstract:
The purpose of this self-research is to study the problems of mediation that occur in actual work at the investigative level. According to the Mediation Act, B.E.2562, suggesting solutions and developing the mediation process to be more efficient. The investigating officer is required to notify these rights and arrange for the disputing parties to enter the mediation process. There is a mediator, who is not the investigative officer, who will do mediation so that the parties can agree on the deal voluntarily. However, it was found that mediation of criminal cases at the investigative level is still inefficient. As a result, the said case cannot be settled or ended at the level of investigators. Therefore, to create more standardized and efficient guidelines, the researcher proposes to amend and reduce the mediation steps, to complete the mediation period at one time. This will reduce the burden on the parties who have to travel to meet both the investigating officer and the mediator afterward. Moreover, mediation facilities within police stations should be improved to be more prepared for operations. It should also be established as a policy to increase incentives for investigative officers to adjust the paradigm and perspective that they have towards the mediation process at the investigative level according to the Mediation Act B.E.2562, which is an alternative justice process but there are more steps and take a longer time. This is different from the main justice process according to the Criminal Procedure Code, which has fewer steps and is completed at one time. For the investigative officers to understand, accept, cooperate, and voluntarily provide more mediation for the parties. Thus, it will result in the mediation process at the investigative level efficiency, time is reduced, and costs are saved. Finally, the cases will go to the court less and it will reduce inequality in access to justice for the people.
