Abstract:
This thesis entitled A Study Of Knowledge Of Vinayavinicchya In Bhikkhunivibhanga has three objectives: 1) to study the adjudication of the code of monastic discipline as appeared in Theravada Buddhist scriptures, 2) to study the adjudication of the code of monastic discipline as appeared in the scripture of Bhikkhunĩvibhaṅga, and 3) to analyze the adjudication of the code of monastic discipline as appeared in the scripture of Bhikkhunĩvibhaṅga. This is a qualitative research done by studying the collected documents and then analyzing them through the descriptive analysis.
In the research, it was found that in the adjudication of the code of monastic discipline as appeared in Theravada Buddhist scriptures the Buddhist monks who are approved and supposed to judge the disciplinary case by the Sangha must possess the justice where they investigate and adjudicate the given case according to the facts provided by both sides, an accuser and defendant. In the consideration, they must follow four types of principles: Sutta, Suttänuloma, Äjariyaväda and Attanomatti.
According to the adjudication of the code of monastic discipline as appeared in the scripture of Bhikkhunĩvibhaṅga, two kinds of judgment are found: 1) the adjudication is overall made through the judgment of a person who behaviorally violates the discipline, for instance, 2) the adjudication is done one by one through the judgment of the root regulation and the sub-regulation from the excepted person, for instance. Once done, the assembly of the Sangha is organized to judge as to whether the code of monastic discipline is violated or not, if so, the Order is thereby laid down by the Buddha.
In the analysis of the adjudication of the code of monastic discipline as appeared in the scripture of Bhikkhunĩvibhaṅga, this research is only focused on the general regulation where one hundred and thirty disciplines are laid down for Bhikkhunĩs. Of which two aspects of the adjudication are classified: 1) the adjudication of the monastic discipline is done in accordance with the formation of Tipiṭaka by which the judgment of ones behaviour in violation what is disciplinarily prohibited by the Buddha. In this respect, it is explained in great detail such as the exception of violation, the first Buddhist monk who violates the discipline, Bhikkhunĩ whose mind is out of control, 2) the adjudication of the monastic discipline is done according to the group of Buddhist monks in the Order; this has taken the examination through the consideration of the damage derived from the violation of the Order, the moral etiquette, such as the wrong view of the Order, non-contentment of likelihood which is considered physically and verbally wrong, intentionally and non-intentionally. It can be claimed that each the adjudication of the discipline leads to the universal principle where the Sanghas assembly is present to examine and to get opinion. Consequently, the principles for the next adjudication of the code of monastic discipline are set up to judge the similar cases; it provides the condition where the correction and modification can be made through the deductive method by which the issue is caused, then the conclusion is done from the violation of such disciplinary.
