Abstract:
Without a doubt, to achieve equality between men and women is a continuing battle. One of the factors that significantly differences women from men is their responsibility for child-rearing and home-keeping. To equalize this gender difference is to aim for a fair share of duty and commitment in the workplace and at home for both genders. Therefore, fathers should be allowed to take paternity leave to care for their children for the best interests of the child as well as to be equal to mothers maternity leave. Paternity leave generally is the period of time for fathers that take after the birth of their children to support the recovery of mothers, to look after newborns and manage household tasks. This independent study investigates and critically analyzes whether there is a legal obligation for Thailand to adopt the paternity leave with a focus on the aspect of gender equality and the best interests of the child from international instruments Thailand is a State Party to including International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC). The methodology of this study is documentary research mainly based on documents, international and domestic laws in effect. Results from examining the aforementioned international instruments and Thai law namely Constitution of the Kingdom of Thailand B.E. 2560 (2017), Gender Equality Act, B.E. 2558 (2015) and Child Protection Act, B.E. 2546 (2003), it reveals that Thailand is legally bound to provide paternity leave under domestic law. The implementation of paternity leave will enable Thai government to send an explicit message to the international arena that Thailand as a State Party is committed to legal obligations of International instruments in advocating gender equality and the best interests of the child by enacting paternity leave policy
