Abstract:
This independent study aims to research the concept , theory , legal issues related to the
recidivism juvenile delinquency by studying of thai legal issues compared with foreign law as
well as analyzing the legal measures to prevent the recidivism juvenile delinquency in order to
obtain the relevant legal guidelines and recommendations.
According to the study, there are several legal problems concerning the punishment of
the recidivism juvenile delinquency in the case of criteria for the age of criminal offenders under
section 144 of the Juvenile and Family Court and Juvenile and Family Procedure Act B.E.2553 ,
which are not in control of juvenile delinquency in society. In other words, there are no specific
laws in Thailand which adding criminal penalties to juvenile delinquents in the case of
recidivism because of serious criminal case and affecting the society.
It is recommended that section 144 of the Juvenile and Family Court and Juvenile and
Family Procedure Act B.E.2553 should be amended by supplementing section 144/1 and section
144/2 in the case of the change and use of recidivism juvenile delinquency schemes as new
provisions for the sake of criminal justice delinquency in order to support juveniles returning to
society , for the benefit of the prevention of society and people.
