Abstract:
The objectives of this research are 1. to study the concepts, theories, the background, principles and
title deed problems of the government to communities 2. to study and analyze problems including obstacles
which related to the title deeds of the government to communities 3. To study the operational results from the
implementation of the policy and legal measures in issuing community deed and 4. to propose guidelines for
solving legal problems and obstacles which related in issuing title deed of the government to communities by
studying from Chanthaburi and Trat areas. The case study found that people inside and outside these areas have
occupied the areas without any documents. Moreover, they have been living there for a long time with
presented evidences such as The certificate of Khun Song Temple in 1808. It cannot be issued any documents
in this area and also leaded to occur disputation between people and government normally. Especially in case of
where people are arrested from invading the National Forest. The area where the group of people have been
possessing for their living is characterized by a deteriorated forest and is located in the community which
causes frequent disputes between the people and government. The government uses aerial photographs that
have been requested by the Royal Forest Department and received additional clarifications from the sheriff of
that area to study in this case.
Most land administration of communities are managed by committee. They act as general
management and linkedour groups with external partners. They also discuss the problems and have a meeting
together by allowing members to comment and find conclusion with the solutions. Every community is the old
community with similar cultural roots and relationship. People get along with their relatives and acquaintances
tightly, as a result they use traditional culture as a tool to solve problems. Theyissue the rules to prevent land
encroachment from people inside and outside the village.Furthermore, they establish a land bank to collect
funds for use in the central business of the group. They have regulations to supervise and manage joint
ownership lands (Or a community title deeds) allowing the land to be used sustainably and not being changed
into an outsider housing. As a result, the dwellings are owned by community members. When the community
deed will be applied to land reform in Chanthaburi and Trat provinces. The effect shown a good work to the
community can be obtained the rights to manage conservation and used state land of government. The rights
will be enable the community to lay down guidelines for land management. Also the rights can be solved
problems in the conservation and used of landsustainably.
