Abstract:
Environment is an essential factor to support human survival. However, it has been largely destroyed by humans not only in peace time but also in times of war or in times of armed conflict. These cause a lot of damage to the environment, as seen in the Indo China war and Gulf war. Due to this problem, it is necessary to consider the protection of the environment, especially the principles of the law of war or of international humanitarian law as seen in Geneva Protocol I Additional to the Geneva Convention and Relating to the Protection of Victims of International Armed Conflicts 1977 and Convention on the Prohibition of Military or Any Other Hostile Use of Environmental Modification Techniques 1976. These treaties have specific provisions for the protection of the environment. Because Thailand does not have any laws or rules providing to protection to the environment in times of armed conflict, so the objective of this research is to study the implications and directions for Thailand to adopt rules which help to implement international humanitarian law by acceding to those treaties. From the study, after becoming a party to the treaties, Thailand will have legal obligations to amend some of the present laws and enact/adopt new laws or rules or policies which are in accordance with the provisions providing protection for the environment, in accordance with those treaties.
