Abstract:
This article is based on the authors research on Legal Problems of Implementing the ASEAN Multilateral Agreement on the Liberalization of Passenger Air Services in the Thai Domestic Aviation Business, Funded by Mae Fah Luang University. ASEAN countries have also concerned this point, so that they are combined together known as ASEAN Community in order to set free international transport by air in ASEAN members. However, it is hard to harmonize their laws and regulations to be perfect unification, especially in case of law enforcement in which it is significantly influenced by different nature of such countries. Accordingly, the ASEAN Multilateral Agreement on the Full Liberalization of Passenger Air Services (MAFLPAS) has been enacted consistently with the ASEAN Regional Guideline Competition Policy. Nevertheless, the MAFPAS is not yet in force as it is just a choice to be voluntary implemented by the members. Additionally, due to some member countries have no written competition law because ASEAN Competition Policy is temporary and conditional enforced, so that there are lack of effective international laws and rules to support the current high competitiveness of airline industry
The outcomes of this study demonstrate that ASEAN members should have international airline business law, in order to govern all airline industry under the same rules, concurrently with the revision of its provisions to be acceptable for implementation from all ASEAN member countries.
