The restrorative justice for using in the mediation process in schools : case study in the conflict arose in school of the central family and juvenile court
Abstract:
This study consisted of the following objectives 1) to study and analyze causes, factors, and components of the conflict in each case study, 2) to study and analyze the application of the mediation process, the concept and theory, and the conflict resolution toolbox in schools and 3) to study the way to increase the efficiency of mediation process in schools. In this study, the three different conflicts cases in schools of Central Juvenile and Family Court and two different conflicts cases in other schools were selected to be case studies by the researcher. The concepts and theories relating to adolescence psychology, social psychology development, Gary T. Furlongs conflict resolution models, and relative communication were applied to manage the conflict between litigants. The researcher used the methods of the analysis and design of the mediation process and the data acquisition by conducting mediations, interviews, and observances to litigants in order to proceed the content analysis of each theoretical case study and present the content according to the objectives of the study. The results of this study are as follows: 1. From analyzing the causes, factors and components of conflicts occurrences, it was found that teenagers have both physical and psychological changes and need to adapt themselves from childhood to adulthood. As for the causes, many factors having influence on violence were personal factor, family factor, bringing up factor, social influence factor, social stimulus, media, violent games. The most important factor was value and attitude of using violence to solving problem and of self dignity. Thus, when the dignity was assaulted, violent behaviors, angers, and loss of emotional control will occur and so teenagers were easily driven to be wrongdoers and violence by their own or by persuaded from friends. In addition, five fundamental causes of conflict consisting of communication, emotions, values, structure, and history were factors leading to a potential conflict and a chance to violence according to the theory of The Wheel of Conflict created by Bernard Mayer, Ph.D. 2. From analyzing the application of the mediation process, the concept and theory, and the conflict resolution toolbox in schools, it was found that according to nature of teenagers the conflict problem would be resolved and ended if teenagers admitted by themselves, not to be compelled to admit but was derived from being given a chance to review past deeds and based on the evidence and witness. Furthermore, the mediation process mixed with the components of theory of family psychology, theory of family psychology, social psychology development in perception and attitude, and Gary T. Furlongs conflict resolution models were applied to analyze and design creative communication techniques and student assistance system for monitoring behaviors in schools which could bring to the emotional intelligence system and the relationship management approach emphasizing on the characteristic of the social relationship which was the heart of mediation process. 3. As for the way to increase the efficiency of mediation process in schools, it was found that the mediation process which was conducted by a group of students under counseling of a teacher was a new mechanism and model to enhance the students to have ideas and mediation basic. Besides, educational institution administrators were required to have a policy to support this mediation process by eliminating any barriers such as regulations, rules, identity, and teachers attitudes so as to promote the students to be mediators in schools in the long term.
