Abstract:
The research on reconciliation techniques for divorce case: case study of divorce cases in the Central Juvenile and Family Court aimed to: 1) gather information and analyze the actual causes of conflict in divorce cases brought before the Central Juvenile and Family Court as a basis for reviewing them with relevant concepts and theories, 2) analyze concepts and theories relating to the procedures for reconciliation in divorce case and rehabilitation of relationship of parties to the marriage bringing the divorce case, as a result of their conflict, before the Central Family and Juvenile Court by investigating and designing reconciliation techniques and considering relationship before, during and after reconciliation, and 3) comparatively analyze the approach to conflict management for divorce case rooted from various conflict causes and techniques for successful reconciliation. This research adopted qualitative method based on the analysis of sample group information gained from 5 subjects.
Findings from the research were as follows:
Divorce cases in the Central Juvenile and Family Court increased in number during 2009 - 2011 and from the analysis, this also reflected the increasing trend. To this end, the researcher intended to review conflict management especially those techniques to be used for managing such conflict in divorce case in the Central Juvenile and Family Court. The researcher also conducted literature review concerning conflict theories including spiral of conflict, triangle of conflict, peaceful means, IRP Model etc. as well as reconciliation techniques for dispute resolution; all of which were utilized for analyzing 5 cases. Furthermore, it was also found that conflict existed in the divorce case mainly originated from failure in communication and to respond to basic human needs according to Maslow's Theory. This study also investigated a Buddhistic approach to dispute resolution for effective reconciliation. It was also suggested by this study that dispute resolution should be guided by each pattern of conflict management.
Finally, the study results also showed that conflict management in divorce case by applying reconciliation technique was efficiently achieved as it could maintain good relationship in the family as opposed to the court proceedings that might deteriorate such relationship in some cases. Proper techniques for reconciliation applied in such divorce case would help facilitate the parties in concern to reach their resolution in due time.
