Abstract: สมาชิกรัฐสภาเป็นผู้ที่มีความสำคัญต่อการเมืองการปกครองในระบบประชาธิปไตย เพราะเป็นผู้ใช้อำนาจนิติบัญญัติ จึงจำเป็นต้องกำหนคุณสมบัติและคุณลักษณะต้องห้ามของบุคคลดังกล่าวเพื่อให้สมาชิกรัฐสภาเป็นผู้ที่มีลักษณะเหมาะสมกับการดำรงตำแหน่งนั้น วิทยานิพนธ์นี้ได้ศึกษาถึงคุณสมบัติและลักษณะต้องห้ามในเรื่องต่างๆ ว่ามีเหตุผลในการกำหนดไว้อย่างไร และมีปัญหาในการบังคับใช้หรือไม่ นอกจากนั้น ยังได้ศึกษากระบวนการควบคุมให้สมาชิกรัฐสภามีคุณลักษณะตามต้องการ ว่ามีกระบวนการอย่างไร และมีปัญหาในการปฏิบัติหรือไม่ด้วย ซึ่งผลในการศึกษาพบว่า บทบัญญัติเรื่องคุณสมบัติและลักษณะต้องห้ามในแต่ละเรื่อง ต่างก็มีปัญหาในทางปฏิบัติแตกต่างกันไป และสำหรับการควบคุมให้สมาชิกรัฐสภามีคุณลักษณะตามที่ต้องการนั้น ก็ยังมีปัญหาในเรื่องกระบวนการควบคุมที่ยังมีความบกพร่องและซ้ำซ้อนกัน ซึ่งทำให้การวินิจฉัยว่า สมาชิกรัฐสภาผู้ใดจะสิ้นสุดสมาชิกภาพเพราะไม่มีคุณลักษณะตามที่กฎหมายกำหนดไว้ เป็นไปโดยไม่มีหลักเกณฑ์ที่แน่นอน สำหรับการแก้ปัญหาต่างๆดังกล่าวนั้น อาจทำได้โดยการแก้ไขกฎหมายในเรื่องที่เป็นปัญหาให้มีความชัดเจนและครอบคลุมถึงวัตถุประสงค์ที่แท้จริงของแต่ละเรื่อง ตลอดจนปรับปรุงกระบวนการควบคุมในส่วนที่ยังเป็นปัญหา ให้รอบคอบรัดกุมและมีประสิทธิภาพยิ่งขึ้น

Abstract: Members of the parliament play significant roles in politics in the regime of democracy because they exercise legislative power ; therefore, it is necessary to regulate the qualification and disqualification of members of; the parliament in order to have appropriate qualification to hold office. This thesis aims to illustrate the qualification and disqualification in certain matters, including the reasons to regulate and the difficulties to apply. Moreover, this thesis aims to illustrate the process to control members of the parliament and also the problems occurred in practice. The result of the thesis finds that the legislations concerning the qualification and disqualification in certain matters have different difficulties in practice and that the process to control members of the parliament has some difficulties because of legal lacunae and the clumsy of laws and legislations, which affect the certainty in determining the terms of office of members of the parliament since the lack of discipline according to law. The recommendation to resolve the problems are to amend the laws and legislations in certain issues to certain clarity to cover the purpose thereof and to improve the process to control members of the parliament to certain effectiveness.
