Abstract: การศึกษาวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาเกี่ยวกับทัศนคติของบุคลากรที่เกี่ยวข้องในการสอบสวนเด็กกับการบังคับใช้กฎหมายว่าด้วยการสอบสวนเด็กในคดีอาญาตามพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความอาญา (ฉบับที่ 20) พุทธศักราช 2542 เพื่อให้ทราบถึงปัญหาและอุปสรรคที่ไม่เอื้ออำนวยต่อการปฏิบัติงานของบุคลากรให้เป็นไปตามเจตนารมณ์ของกฎหมายฉบับนี้ และเพื่อเสนอแนะแนวทางในการปรับปรุงกฎหมายฉบับดังกล่าวเพื่อให้มีความเหมาะสมกับสังคมในปัจจุบันมากขึ้น เพื่อให้เกิดประโยชน์สูงสุดในการคุ้มครองสิทธิเด็ก โดยทำการเก็บรวบรวมข้อมูลและประเมินผลอย่างเป็นระบบโดยใช้เทคนิควิจัยทั้งในเชิงปริมาณ ได้แก่การเก็บรวบรวมข้อมูลโดยใช้แบบสอบถาม (Questionnaires) จำนวน 220 ชุดกับกลุ่มตัวอย่างที่ศึกษา และการวิจัยทางมานุษยวิทยา (Anthropoligical field research) เพื่อรวบรวมข้อมูลในเชิงคุณภาพ โดยเลือกใช้วิธีการสัมภาษณ์เจาะลึก (In-depth Interview) กับผู้ให้ข่าวสำคัญ (Key Informants) จำนวน 10 คน สำหรับข้อมูลเชิงปริมาณเพื่อรวบรวมข้อมูลได้แล้วจะนำมาวิเคราะห์โดยใช้วิธีทางสถิติ ได้แก่ การแจกแจงความถี่ (Frequency) การหาค่าร้อยละ การหาค่ามัชฌิมเลขคณิต (Mean) และทำการพิสูจน์สมมติฐานโดยพิจารณาจากความเป็นอิสระระหว่างตัวแปรโดยใช้การทดสอบค่า Chi-Square ที่ระดับนัยสำคัญทางสถิติที่ 0.05 และหาค่า GAMMA เพื่อดูทิศทางของความสัมพันธ์ระหว่างสองตัวแปรทั้งสอง โดยใช้โปรแกรมสำเร็จรูปสำหรับการวิจัยทางสังคมศาสตร์ (Statistical Package for the Social Sciences SPSS for Windows) และวิเคราะห์เนื้อหา (Content Analysis) สำหรับข้อมูลเชิงคุณภาพ ผลการวิจัยพบว่า ตัวแปรทั้งหมดได้แก่ สถานภาพการมีบุตร สายอาชีพที่ปฏิบัติหน้าที่ ประสบการณ์ทำงานในสายอาชีพ ประสบการณ์ทำงานที่เกี่ยวข้องกับเด็ก ความรู้ความเข้าใจในเจตนารมณ์และข้อกำหนดของกฎหมาย ทัศนคติต่อความยุ่งยากและซับซ้อนของกฎหมายมีความสัมพันธ์กับทัศนคติของบุคลากรที่เกี่ยวข้องในการสอบสวนเด็กที่มีต่อการบังคับใช้กฎหมายฉบับนี้

Abstract: The objective of this research was to study about the attitude of personnel concernning to law enforcement as child investigation of criminal law : by the statute of Criminal Procedure Code Revision in 1998 (Rev.20) for knowing the problems of and obstacles which aren't suitable for operational of personnel concernning to law enforcement as child investigation of criminal law and gave reccommendation to improve this law for suitable of present society. The research collected data and evaluated in systematic by using the quantitative research method by distributing 220 questionnaires with the population sampling and used the anthropological field research method to collect the qualltative data by using in-depth interview with 10 key informants. For the quanliative data, the researcher analyzed data by using statistic method with frequency, percentage, mean and proved the hypothesises by using chi-square with a significant level at 0.05 and using GAMMA value to find the direction of relation between two variables and analyzed the qualitative data by content analysis. The research found that the personnel concernning to law enforcement as child invertigation of criminal law who had child, different roles in concerning, more experiences in career, more experiences in work concernning the child, the knowledge about the law enforcement of criminal procedure code revision in 1998 and the attitude to the complexity of this law are related with the attitude to this law enforcement.
