Abstract:
Thailand is initiating a program to provide services relating to Trustmarks, to promote trust and confidence in electronic commerce, which is a method of self-regulation for business operators apart from enacting a law since 2004. An important duty of a Trustmark Service Provider is to stipulate regulations of issuing a Trustmark and a code of conduct in electronic commerce with the same standard as regulations of both internal and foreign laws. It is necessary to study every aspect of related laws. From studying the related Thai laws comparing with foreign laws, it is found that the enforcing Thai laws are not applying for the standard practice of the Trustmark Service Provider adequately. Additionally, the Trustmark Service Providers will also face with the problem of laws, which is still unclear, especially protecting of the rights of the Trustmark Service Provider, monitoring and enforcing the Trustmark Holder, and liability of the Trustmark Service Provider. Therefore, if Thailand enacts a specific law for a Trustmark service; it can solve any problems of compliance with the Trustmark Service including problems related to electronic commerce.
