Abstract:
This research mainly focuses on ideas, investigation proceeding, and extra judicial killy process in the Criminal Procedure Code. It also analyses problems arisen from the effectiveness of protection against the rights of people related to death. The power and duty of investigation officer and public prosecutor in the extra judicial killy process are additionally included. From the study, the Criminal Procedure Code grants an investigation officer the power to conduct extra judicial killy reports. Although a public prosecutor may issue orders for additional investigation or submitting witnesses for further inquiry, it can only be done by investigation officer. Thereafter, 27th Amendment of Criminal Procedure Act B.E. 2550 grants a public prosecutor the power and role to co-investigate with investigation officer. However, he may only give advice and examination, not governing the investigation, which may cause issues about transparency and trustworthiness of the investigation conducted by police organization. This note guides directions on how to improve the extra judicial killy process. Known of his impartiality, the public prosecutor is recommended to have more roles in the extra judicial killy process. The Attorney General, acting officer, or assigned public prosecutor should be responsible in the extra judicial killy investigation and other related cases for the security of justice to all parties. To give the autopsy report more quality, a forensic medical doctor should be granted the power and duty to perform autopsy and make reports in which the public prosecutor and investigation officer participate
