Abstract:
During the last decade Thailand has confronted with the problem of a large number of illegal immigrants entering the country. This was due to the impact of economic poverty, politics as well as civil wars prevalent in neighboring countries both bordering countries and those which are far away. These groups of aliens have caused a host of problems including illegally working, grouping up into influential bands leading to the problems of criminality, drugs, prostitution, transnational crimes and security of Thailand. At present, the Government has an urgent policy to solve the aforementioned problem by designating the office concerned with controlling immigration, i.e. the immigration Bureau under the Royal Thai Police to be accountable. It has also given human resources, financial support as well as authority. The Immigration Act B.E. 2522 is instrumental in solving the above problem. In scrutinizing the Immigration Act B.E.2522, it is found out that problems and obstacles still persist with respect to organizational structure and the offices enforcing the law, the boundary of authority under the law, transparency and the loopholes ofthe law, the judgement of officials which have no principles in enforcing the law as properly as determined by the law. They even set standards for practice for various groups of people who are enforced under this law.This thesis istherefore undertakento study the circumstances of the problem, the causes of the problem, as well as summarizing the problems and suggesting guidelines to rectify and improve upon the Immigration Act B.E.2522 so as to attain effectiveness in enforcing the law as intended by it in preventing and controlling aliens who may instigate problems relevant to economic, social and political problems. it may assist in setting standards and guidance to officials to properly enforce this law which may be beneficial to the people and the country in the future.
