Abstract:
Legal measure to combat crime is very significant for the reason to prevent people and society from hazardous effect of a criminal activities specially, crime relating to gambling. Since 1953, Thailand has implemented the Gambling Act 1953 which criminalized the gambling and those, who committed, would be sanctioned by criminal law.Although there are both direct and indirect measures to enforce the illegal gambling activities, the prevention and suppression of gambling have failed due to the society's attitude and perception. Apart from that, the law enforcement is not efficiency in practice.According to the study, it is understood that gambling is only a normal activity in a society which affect to the gamblers and their relatives, and neither it does damage the overall society. Hence, this society's perception and attitude have been carried on for a long time, therefore, it is considerable that gambling, in some case is not an offence.The present legal measure to counter the gambler activities does not have any impact to those conspirator or supporter of the gambling due to the limitation of proceeding against offenders is inefficient.Initially, The pattern of gambling was simple if it is a small amount of money betting but it has turned to be complicated as it is more difficult to find guilty and that links to large amount of assets. This may be create a great effect to society and economic system simultaneously and violently more than using the legal measure to counter the gambling offences efficiently.Therefore, it is necessary to regulate the measures which are efficient enough to cope with offenders and to be more effectively including the asset forfeiture measure as well.The Anti-money Laundering Law is one of the most efficient legislature which enables to counter illegal gambling business successfully. It states that the asset forfeiture measure are capable as it suspends the economic growth of criminals.It is recommended that the implementation of anti-money laundering measure against gambling will consequently effect to the gambling which incurs the impact to the economic situation of country. Hence, it would be appropriate to may be amend some specific gambling offence as a predicate offence under the Anti-Money Laundering Act.
