Abstract: วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์ในการศึกษาปัญหาการจัดซื้อจัดจ้างขององค์การบริหารส่วนตำบล ตามระเบียบกระทรวงมหาดไทยว่าด้วยการพัสดุขององค์การบริหารส่วนตำบล พ.ศ. 2538 โดยเฉพาะการจัดซื้อจัดจ้างโดยวิธีสอบราคาและวิธีประกวดราคาซึ่งจะต้องดำเนินการให้มีการเเข่งขันกันอย่างเป็นธรรม แต่ปรากฏว่าการดำเนินการจัดซื้อจัดจ้างในวิธีการดังกล่าวก่อให้เกิดปัญหาการทุจริตของเจ้าหน้าที่ที่มีอำนาจสูงสุดในหน่วยงานนั้นตามระเบียบกระทรวงมหาดไทยว่าด้วยการพัสดุและรัฐมนตรีที่มีอำนาจในการกำกับดูแลส่วนราชการนั้น ทำให้รัฐเสียประโยชน์ในการใช้งบประมาณแผ่นดิน ในวิทยานิพนธ์นี้เป็นการวิจัยเอกสาร โดยได้ศึกษารูปแบบและวิธีการการใช้อำนาจของเจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินการจัดซื้อจัดจ้างตามระเบียบกระทรวงมหาดไทยว่าด้วยการพัสดุ โดยมุ่งเน้นถึงการใช้งบประมาณแผ่นดินในการจัดซื้อจัดจ้าง และได้ศึกษาสภาพปัญหาดังกล่าวซึ่งหากว่าได้มีการปรับบปรุงกฎหมายในส่วนที่เกี่ยวข้องให้รัดกุมยิ่งขึ้นก็อาจเเก้ปัญหาดังกล่าวได้อีกระดับหนึ่ง จากการศึกษาเห็นว่ารัฐควรวางมาตรการในการควบคุมการใช้อำนาจของเจ้าหน้าที่ คือ 1. สร้างกลไกการควบคุมการจัดซื้อจัดจ้างให้มีความโป่รงใส โดยกำหนดหลักเกณฑ์การจัดหาพัสดุที่เป็นมาตรฐาน ประกอบกับให้องค์กรอิสระเข้าตรวจสอบการใช้อำนาจของเจ้าหน้าที่ในขั้นตอนต่าง ๆ ได้ 2. การใช้สิทธิในการอุทธรณ์การปฎิบัติหน้าที่ของเจ้าหน้าที่ในระหว่างที่มีการดำเนินการจัดซื้อจัดจ้างในแต่ละขั้นตอน สมควรที่จะกำหนดให้มีการอุทธรณ์หรือร้องทุกข์ ได้ หากปรากฏว่าการจัดซื้อจัดจ้างในครั้งนั้นดำเนินการโดยไม่ถูกต้อง และสามารถที่จะขอให้หยุดการดำเนินการไว้ชั่วคราวก่อนจนกว่าจะได้มีการไต่สวนเสร็จสิ้น 3. ต้องพัฒนาบุคลากรด้านพัสดุให้มีความรู้ ความสามารถ เนื่องจากในแต่ละขั้นตอนของการจัดหาพัสดุจำเป็นอย่างยิ่งที่จะต้องใช้เจ้าหน้าที่ที่มีความรู้ความสามารถเฉพาะด้านจะทำให้การจัดซื้อจัดจ้างครั้งนั้นได้พัสดุที่มีคุณภาพตามต้องการ 4. ต้องมีการแก้ไขระ เบียบกระทรวงมหาดไทยว่าด้วยการพัสดุโดยกำหนดให้เป็นกฎหมายบังคับใช้กับการจัดซื้อจัดจ้างในองค์กรส่วนท้องถิ่นโดยเฉพาะ และกฎหมายดังกล่าวจะต้องวางกลไกการควบคุมการจัดซื้อจัดจ้างในทุกขั้นตอน ทั้งก่อนและหลังการทำสัญญา เพื่อให้มีประสิทธิภาพมากยิ่งขึ้น 5. จะต้องมีกฎหมายเอาผิดกับข้าราชการ นักการเมือง ผู้นำท้องถิ่น หรือบุคคลภายนอกที่เข้ามามีส่วนร่วมกับการทุจริตในการจัดซื้อจัดจ้าง โดยได้กระทำในลักษณะต่างๆ อันเกิดความเสียหายต่อราชการ ไม่ว่าบุคคลนั้นจะเข้ามาโดยทางตรงหรือทางอ้อมก็ตาม โดยสรุปรัฐควรมีเครื่องมือตรวจสอบการใช้จ่ายงบประมาณในการจัดซื้อจัดจ้างอย่างมีประสิทธิภาพ ซึ่งการตรวจสอบดังกล่าวจะต้องทำตามขั้นตอนภายในหน่วยงานก่อนการจัดซื้อจัดจ้าง ระหว่างการปฎิบัติิิตามสัญญา และเมื่อได้ทำการตรวจงานแล้วโดยกำหนดมาตรฐานความรับผิดชอบของเจ้าหน้าที่แต่ละขั้นตอนให้ชัดเจน รวมถึงมาตรการการลงโทษคู่สัญญาในกรณีไม่สุจริตหรือทิ้งงานด้วย

Abstract: The purpose of this research is to study the problems of purchase and hire of Tumbol Administrative Organization according to Rule of the Ministry of Interior Affair on Procurement Administration of Tumbol Administrative Organization B.E.2538. This study especially focus on the procedure of price inspection and biding. Generally speaking, rule of the said procedure will enable a fair transaction to be done transparently. However, it may cause trouble by providing a chance for high ranking officer to commit a corruption. As a result, the nation will lost its interest and reduces its budget.This research, will look mainly into documents and study forms and methods of using power of the officer who concerns purchase and hire as the rule of the ministry of Interior Affair on Procurement determined. The state should set up the following measures to control the power of the officer concerned.1. establish the implement in order to enable the purchase and hire to be transparency by standardizing the rules together with establish an independent organization to inspect the discretion of the officer in each stage of the transaction.2. establish the right to bring an action of abuse power of the officer to the court while the purchase and hire are being processed in each stage and the transaction can be stopped until the inspection is finished.3. develop a personnel concerning the procurement for being a specialize since each stage of the transaction is indispensable, hence, a capable personnel is important to acquire a suitable product.4. transform rule of the Ministry of interior Affair on Procurement to be a Procurement Act in order to be enforceable for a local organization. Also, the act must implement the measures to control the hire and purchase in each stage either before or after the transaction.5. establish the law to punish officer, politician or another person involving inthe corruption of purchase and hire, no matter how the corruption is done in any action to harm the interest of state directly or indirectly.In the conclusion, state should have a measure to inspect the budget of hire and purchase efficiently. The said measure must be conducted step by step according to the internal procedure of local organization while, after and before the transaction is done. Also, such an adequate measure shall determine the responsibility of the officer in each stage of transaction and the punishment of each party acting in ill fate or abandoning the agreement.
