Abstract:
Commonly, utilization of words or sentences as a trademark is in a form that describes the character or the quality of goods. However, utilization of words or sentences in such a manner may in actuality neither distinguish their goods from the other goods nor allow other parties to utilize those same words or sentences to describe, characterize and/or name their own products.The objective of the study is to analyze this right to utilize words or sentences as trademarks and to study example or determine methods of the utilization of these types of trademarks. The study will discuss the effects of, problems with and solutions for the use of these types of trademarks in conformity with the objectives of the law.The research revealed that in Thailand words and/or sentences are used as trademarks to describe the character or quality of goods and also to rename products. Insufficient regulations exist relating to the utilization of these types of trademarks.The study will propose methods for the regulation of the use of words and/or sentences as trademarks so that trademark owners must distinguish their goods from those of others and thus benefit the public when purchasing goods.
