Opinion of criminal justice personnel on the enforcement of suspended prosecution
Abstract:
The objective of investigation was to ascertain opinions of criminal justice
personnel regarding enforcing lawsuit suspension and to commend alternative
solutions to the overloaded court cases, and congested prisoners in the criminal justice
of Thailand. A sample of 150 police inspectors, public prosecutors, judges, probation
officers and corrections officers were surveyed. Sets of questionnaires were used in
data collection for a quantitative method. SPSS+PC was used in analysis and the
statistical applications were frequency, percentage, mean, standard deviation one-way
ANOVA and the Scheffe multiple regression analysis. Findings were concluded as
follows:
Most personnel commented that lawsuit suspension helped to solve the
problems of overloaded court cases, and congested prisons. It was also considered a
new justice administration indispensable for the public benefit and law enforcement in
Thailand. In addition, the samples commented that imprisonment labeled offenders
even in the short term. It was further found that lawsuit suspension was viewed
differently by people of different background according to such matters as their
occupation, income, extra earning, and acknowledgement of the lawsuit suspension.
Recommendations
1. Criminal justice organization of Thailand should organize conferences and
seminars not only for their own personnel but also for the police, public prosecutors,
the judges, and the probation officers, corrections officers to realize the necessity,
advantages and disadvantages of the enforcement of lawsuit suspensions as an
alternative. Our neighboring countries have already applied it to solve the overloaded
court case and the congested prison problems.
2. Qualitative research should also be conducted to further explore the
dimension of problems to the enforcement of lawsuit suspensions
