Abstract: การศึกษาปริจเฉทการสอบปากคำระหว่างพนักงานสอบสวนกับผู้เสียหายในการร้องทุกข์ให้เป็นคดีอาญามีวัตถุประสงค์ในการศึกษาโครงสร้างของการสอบปากคำระหว่างพนักงานสอบสวนกับผู้เสียหายในการร้องทุกข์ และศึกษากลวิธีที่พนักงานสอบสวนสอบปากคำผู้เสียหายในการร้องทุกข์คดีอาญา โดยเก็บข้อมูลจากการบันทึกเสียงสถานการณ์จริงในการร้องทุกข์ทั้งหมด 50 สถานการณ์ จากสถานีตำรวจภูธร อำเภอเมือง จังหวัดขอนแก่น ผลการวิจัยพบว่า โครงสร้างของการสอบปากคำในการร้องทุกข์ปรากฏขั้นตอนชัดเจนตายตัว คือ การเปิดการสนทนา การดำเนินการสนทนา และการปิดการสนทนา ในการเปิดการสนทนาประกอบด้วย 2 ขั้นตอน คือ การทักทายและการสอบถามวัตถุประสงค์ การดำเนินการสนทนาที่พนักงานสอบสวนตัดสินใจรับเรื่องร้องทุกข์ประกอบด้วย การสอบถามเพื่อระบุเหตุการณ์และระบุตัวผู้กระทำความผิด การสอบถามประวัติส่วนตัว และการสอบถามเพื่อขอรายละเอียดสำคัญที่เกี่ยวข้อง แต่การดำเนินการสนทนาที่พนักงานสอบสวนตัดสินใจไม่รับเรื่องร้องทุกข์ ปรากฏเพียงการสอบถามเพื่อระบุเหตุการณ์และระบุตัวผู้กระทำความผิด และการสอบถามประวัติส่วนตัว และการปิดการสนทนาพบ 2 ลักษณะ คือ การปิดการสนทนาที่พนักงานสอบสวนรับเรื่องร้องทุกข์ซึ่งประกอบด้วย การยืนยันรับเรื่องร้องทุกข์ การสานต่อคำร้องทุกข์ และการกล่าวคำอำลา ส่วนการปิดการสนทนาที่พนักงานสอบสวนไม่รับเรื่องจะประกอบด้วย การให้คำแนะนำ และการกล่าวคำอำลา ผลการศึกษากลวิธีการสอบปากคำพบว่า พนักงานสอบสวนใช้กลวิธี 2 ลักษณะ คือ กลวิธีหลักในการสอบปากคำ และกลวิธีเสริมในการสนทนา กลวิธีหลักในการสอบปากคำพบ 2 ประเด็น คือ รูปประโยคที่ใช้ถาม และกลวิธีการถาม รูปประโยคที่ใช้ถาม ประกอบด้วย รูปประโยคคำถามและรูปประโยคบอกเล่า ในประเด็นกลวิธีการถามสามารถแบ่งตามวัตถุประสงค์ในการใช้ได้เป็น 2 วัตถุประสงค์ คือ กลวิธีที่ใช้เพื่อสอบถามข้อมูลที่เป็นประเด็นหลัก และกลวิธีที่ใช้เพื่อเน้นย้ำคำตอบของผู้เสียหาย นอกจากนี้พนักงานสอบสวนยังใช้กลวิธีเสริมในการสอบปากคำ ประกอบด้วย กลวิธีที่มีวัตถุประสงค์เพื่อให้ข้อมูลแก่ผู้เสียหาย กลวิธีที่มีวัตถุประสงค์เพื่อยืนยันความถูกต้องของข้อมูล กลวิธีที่มีวัตถุประสงค์เพื่อต้องการให้ผู้เสียหายปฏิบัติตาม กลวิธีที่มีวัตถุประสงค์เพื่อให้ผู้เสียหายผ่อนคลายความวิตกกังวล และกลวิธีที่มีวัตถุประสงค์เพื่อแสดงความเป็นกันเอง

Abstract: The thesis aim at studying the structure of inquiry discourse between the inquisitor and the injured person. And study to the inquisitor's strategy. The data used is based on the complaint 50 cases. Based on the data found, the structure's inquiry discourse compose of the explicit components; 1) the entry into the conversation, 2) body the conversation, and 3) the exit from the conversation. The entry into the conversation composed of two parts; 1) greeting and 2) inquire for objective. Body the conversation in case of the inquisitor receive the complaint compose of 3 parts; 1) inquire for description the event and offender, 2) inquire for background of the injured person, and 3) inquire for details. But in case of the inquisitor decline the complaint compose of 2 parts; 1) inquire for description the event and 2) offender include inquire for background of the injured person. The exit from the conversation appear 2 cases. First, case of the inquisitor receive the complaint have 3 parts. Starting from confirm the complaint. Later, succeed the complaint and finish to farewell. The exit form the conversation in case of the inquisitor decline the complaint compose of 2 parts to suggestion and farewell. In study of strategy, found 2 parts; 1) inquiry strategy and 2) supporting strategy. Inquisitor used inquiry strategy to inquire data and facts. Inquiry strategy included 2 characters; 1) sentence forms and 2) ask strategy. Sentence forms are composed of the affirmation and question. Ask strategy compose of 2 objectives; 1) use for asking the main point and 2) use for emphasis the answer of the injured person. Besides the inquisitor use the supporting strategy for helping to finish the conversation. This strategy have including 5 objectives; 1) use for informing the injured person, 2) checking accuracy of data, 3) following the inquisitor's order, 4) relaxing the injured person form the worry and 5) exposing the informal relationship.
