A Comparative Study for Development of The Alternative Dispute Resolution Process of The Community Justice Center and The Public Engaging Mediation Center: The Case Study in Phaya Mengrai District
Abstract:
The objective of this research article is to study the laws, regulations, and rules related to the alternative dispute resolution process of the Community Justice Center and the Public-Engaging Mediation Center in Phaya Mengrai District, Chiang Rai Province by conducting qualitative research studies. The results of the study found that the dispute resolution process of the Community Justice Center is different from the dispute resolution process of the Public-Engaging Mediation Center according to the Mediation Act B.E. 2562, there are many factors such as the jurisdiction of the case, the composition, acquisition and qualifications of the mediators, the differences in the effectiveness of dispute settlement agreements, all these three issues, are important factors in the success of the Community Justice Center in the area of Phaya Mengrai District, Chiang Rai Province, in settlement the disputes. So the researcher is interested in studying and analyzing laws and information from the target groups to suggest guidelines that will be useful in promoting and strengthening the community justice process to be more efficient.
