Abstract: การศึกษาวิจัยครั้งนี้มีวัตถุประสงค์เพื่อเพื่อศึกษาถึงปัจจัยต่าง ๆ ที่มีผลต่อแนวทางการพัฒนาประสิทธิ ภาพของทนาย อาสาและเพื่อเสนอแนะแนวทางการพัฒนาประสิทธิภาพของทนายอาสา ซึ่งการศึกษาวิจัยในครั้งนี้ผู้วิจัยได้ใช้วิธีการศึกษาวิจัยแบบผสมผสาน (Mixed Methods Research) ซึ่งเป็นรูปแบบการวิจัยเชิงปริมาณและการวิจัยเชิงคุณภาพควบคู่กัน โดยกลุ่มตัวอย่างที่ใช้ในการศึกษาวิจัยเชิงปริมาณ ได้แก่ ผู้ใช้บริการที่มาปรึกษาคดีความต่อทนายอาสา จำนวนทั้งสิ้น 369 คน โดยใช้แบบสอบถามเป็นเครื่องมือในการเก็บรวบรวมข้อมูล สถิติที่ใช้ในการวิเคราะห์ข้อมูล ได้แก่ ค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน การวิเคราะห์ความแปรปรวนและการวิเคราะห์การจำแนกพหุ ส่วนการศึกษาวิจัยในเชิงคุณภาพ กลุ่มตัวอย่างที่ใช้ในการศึกษาวิจัย ได้แก่ นายกสภาทนายความ 1 คน ทนายอาสา 2 คน รวมทั้งสิ้น 3 คน โดยใช้วิธีการสัมภาษณ์เชิงลึกและมีแบบ สัมภาษณ์เป็นเครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล โดยวิธีการเลือกกลุ่มตัวอย่างแบบเจาะจง ผลการศึกษา พบว่ากลุ่มตัวอย่างส่วนใหญ่เป็นเพศชาย มีอายุ 41-50 ปี สมรสแล้วอยู่ร่วมกัน จบการศึกษาระดับปริญญาตรี ประกอบอาชีพธุรกิจส่วนตัว/ค้าขาย มีระดับรายได้ต่อเดือนมากกว่า 25,000 บาทขึ้นไป รู้จักทนายอาสาจากอินเตอร์เน็ตและเคยเข้ารับการปรึกษาคดีจากทนายอาสาเป็นครั้งแรก ผลการทดสอบสมมติฐาน พบว่า ปัจจัยที่มีผลต่อแนวทางการพัฒนาประสิทธิภาพของทนายอาสาทั้ง 4 ด้าน ประกอบด้วย ด้านความเชื่อมั่นและความเชื่อถือด้านความพึงพอใจในการใช้บริการปรึกษาคดีความต่อทนายอาสา ด้านจริยธรรมในตัวทนายอาสาและด้านทัศนคติการใช้บริการทนายอาสา ได้แก่ เพศ (Sig = 0.000) อายุ (Sig = 0.000) สถานภาพการสมรส (Sig = 0.000) ระดับการศึกษา (Sig = 0.000) อาชีพ (Sig = 0.000) ระดับรายได้ต่อเดือน (Sig = 0.000) การรู้จักทนายอาสา (Sig = 0.000) และจำนวนครั้งในการใช้บริการปรึกษาทนายอาสา (Sig = 0.000) อย่างมีนัยสำคัญทางสถิติที่ระดับ 0.05 ข้อเสนอแนะจากการวิจัยทางสภาทนายความควรมีการเสริมสร้างความรู้ คุณธรรม จริยธรรมศีลธรรมให้กับทนายความอาสาอย่างต่อเนื่องและเป็นรูปธรรมเพื่อเป็นการเพิ่มประสิทธิภาพในการปฏิบัติงานของทนายอาสาในอนาคต รวมทั้งควรมีการวางนโยบายในการจัดการฝึกอบรมบุคคลที่สอบเข้ามาเป็นทนายโดยจะเรียกว่าทนายอาสาผู้ช่วยซึ่งมีขอบเขตในการทำหน้าที่เป็นผู้ช่วยทนายอาสาก่อนที่จะมาเป็นทนายอาสา เพื่อเป็นการเตรียมความพร้อมก่อนจะมาทำหน้าที่เป็นทนายอาสาและเพื่อเป็นการพัฒนาหรือการเพิ่มประสิทธิภาพในการให้คำปรึกษาหรือการให้บริการของทนายอาสาต่อไป

Abstract: This research was a mixed methods research by using both quantitative and qualitative research models aims to study the measure to increase efficiency of volunteer lawyers and various factors that affect the development approach of the effectiveness of volunteer lawyers along with to offer guidance for developing volunteer lawyers. The studied sample in the quantitative research were 369 service users who have experienced on consultations with volunteer lawyers by using questionnaires as a tool for data collection. The statistical data analysis was a percentage, mean, standard deviation, analysis of variance, and multiple classifications. The qualitative research was specified sampling by using an in-depth interview as a tool with the president of the lawyer council, and 2 volunteer lawyers, and collected data from an interview template. Most of the samples were male with an age of 41-50 years, married status, graduated bachelor's degree, self-employment/merchants with a monthly income more than 25,000 baht, received the information about the volunteer lawyers from the internet and have been consulted for the first time. The hypothesis testing revealed the 4 factors that affecting the development approach of the effectiveness of volunteer lawyers consisted of confidence and trust, satisfaction in using the consultation service, ethics of volunteer lawyers, and attitudes in counselling which include gender (Sig = 0.000), age (Sig = 0.000), marital status (Sig = 0.000), education level (Sig = 0.000), occupation (Sig = 0.000), monthly income (Sig = 0.000), knowing the volunteer lawyers (Sig = 0.000) and the number of times consulting case consultation service from volunteer lawyers (Sig = 0.000) with statistical significance at 0.05. The suggestions from this study were the knowledge, morality, and ethics of volunteer lawyers should be reinforced continuously and concretely from the lawyer council to increase the efficiency and improve volunteer lawyers' performance in the future. Additionally, the lawyer council should be established policies to set up a training process for those who take a bar examination as the assistant volunteer lawyers before becoming a volunteer lawyer to develop and increase efficiency on a legal consultation service.
