Abstract: In Thailand, the policy maker and authorities in criminal justice system have been trying to figure out the way to deal with sex crimes for a long time; however, situations related to sexual violence occur every day, and the capital punishment cannot deter sex crimes. Accordingly, to provide the new options for dealing with sex crimes, this research aims to study the sex offender registry system from the countries where this system exists by studying and exploring the current used of sex offender registry system which can be applied to Thailand and also study problems, obstacles and possibility if sex offender registration will be adopted to apply in Thailand. In order to examine law enforcement perspectives on sex offender compliance with registration obligations and the possibilities to initiate this system in Thailand, a qualitative methodology was applied in this study through documentary research, focus group discussion and in depth interviews. The participants and key informants included police officers, correctional officers, probation officers, public prosecutors and the scholar expert in criminal law and criminology in Thailand. The results show that it is reasonable to bring the sex offender registry system to Thailand, but it must suit the Thai's context. The priority concern of using this system is labelling the sex offenders. The findings also show that not all offenders should be listed on the sex offender registry database, and the proper criteria to classify the offender into the system must be relevant to the existing laws. Moreover, the government must promote agency cooperation in order to provide the greatest amount of accuracy and clarity and support their performance for sex crime preventions in practical ways. In addition, educating people and public hearing should be continuously done before and after establishing the sex offender registry system

Abstract: ในประเทศไทยนักนโยบายและเจ้าหน้าที่ผู้บังคับใช้กฎหมายในกระบวนการยุติธรรมพยายามที่จะค้นหาวิถีทางที่ดีที่สุดในการจัดการกับอาชญากรรมทางเพศตลอดระยะเวลาที่ผ่านมาแต่อาชญากรรมทางเพศก็ยังคงเกิดขึ้น และโทษประหารชีวิตก็มิได้ช่วยยับยั้งการเกิดอาชญากรรมทางเพศ ด้วยเหตุนี้ เพื่อนำเสนอทางเลือกใหม่ในการจัดการกับอาชญากรรมทางเพศ งานวิจัยนี้จึงมีวัตถุประสงค์เพื่อศึกษาระบบลงทะเบียนผู้กระทำผิดคดีทางเพศจากประเทศที่มีการใช้ระบบดังกล่าวนี้อยู่ในปัจจุบัน เพื่อเรียนรู้และค้นพบแนวทางที่เหมาะสมอันนำมาปรับใช้ให้เข้ากับประเทศไทย นอกจากนี้ผู้วิจัยได้ทำการศึกษาเกี่ยวกับปัญหา อุปสรรคและความเป็นไปได้หากมีการนำเอาระบบลงทะเบียนผู้กระทำผิดคดีทางเพศมาใช้ในประเทศไทยด้วยเพื่อที่จะทราบถึงแนวความคิดของเจ้าหน้าที่ผู้บังคับใช้กฎหมายที่มีส่วนเกี่ยวข้องกับการจัดการผู้กระทำผิดคดีทางเพศและความเป็นไปได้ในการริเริ่มสร้างระบบลงทะเบียนผู้กระทำผิดคดีทางเพศ ในประเทศไทย จึงได้ศึกษาด้วยระเบียบวิธีวิจัยแบบการวิจัยเชิงคุณภาพ โดยวิธีการศึกษาเชิงเอกสาร การสนทนาแบบกลุ่มและการสัมภาษณ์เชิงลึก ซึ่งผู้เข้าร่วมการวิจัยและผู้ให้ข้อมูลสำคัญประกอบด้วยเจ้าหน้าที่ตำรวจ เจ้าหน้าที่ราชทัณฑ์ เจ้าหน้าที่คุมประพฤติ เจ้าพนักงานอัยการและผู้เชี่ยวชาญด้านกฎหมายอาญาและอาชญาวิทยาในประเทศไทย ผลการศึกษาพบว่า มีความสมเหตุสมผลในการนำเอาระบบลงทะเบียนผู้กระทำผิดคดีทางเพศในประเทศไทยมาใช้แต่ต้องปรับรูปแบบให้เข้ากับบริบทของประเทศไทย สิ่งที่ต้องให้ความสำคัญเป็นลำดับแรกคือการถูกตีตราผู้กระทำผิดคดีทางเพศหากใช้ระบบลงทะเบียนผู้กระทำผิดคดีทางเพศ ผลการศึกษายังแสดงว่าไม่ใช่ผู้กระทำผิดคดีทางเพศทุกรายที่ต้องถูกใส่ชื่อลงทะเบียนไว้ในระบบฐานข้อมูลและหลักเกณฑ์ที่เหมาะสมที่จะจำแนกผู้กระทำผิดคดีทางเพศในระบบต้องเกี่ยวข้องกับกฎหมายที่มีอยู่ นอกจากนี้ รัฐบาลจะต้องสนับสนุนความร่วมมือของหน่วยงานเพื่อที่จะให้ระบบลงทะเบียนผู้กระทำผิดคดีทางเพศถูกใช้อย่างถูกต้อง มีความชัดเจนและสามารถใช้ระบบลงทะเบียนผู้กระทำผิดคดีทางเพศเพื่อป้ องกันอาชญากรรมทางเพศได้ในความเป็นจริง นอกจากนี้การให้ความรู้และการรับฟังความคิดเห็นจากประชาชนควรทำอย่างต่อเนื่องทั้งก่อนและหลังการสร้างระบบลงทะเบียนผู้กระทำผิดคดีทางเพศ
