Abstract: The purpose of this study was to investigate the nature of the offense and the characteristics of criminals appropriate for death penalty, the nature of the offense punishable by death penalty of Thailand, the model of Death Penalty and the appropriate punishment to be used if death penalty is to be abolished in Thailand, to find out how the abolition of criminal acts that are not consistent or suitable with the philosophy of death penalty, and define punishment to suit the new characteristics and fault characteristics of the offender in order to reform the death penalty laws of Thailand to be consistent and legitimate with the international human rights. This was an integrated qualitative and quantitative approach by gathering information from relevant documents and previous research which were analysed to create questionnaires. The 405 samples were selected using multi-stage random sampling from the Office of the Attorney General and the Office of the Judiciary sectors 1 to 9 including the public prosecutors and judges. Data were then collected using in-depth interviews with individuals who have roles and influence in thinking about people in Thai society such as academics, human rights scholars, and lawyers. The researcher selected 15 people who were able to provide relevant and useful information for the research. The statistics used in the analysis were the percentage and mean. The results showed that the death penalty is appropriate for offenses against life, guilty of security, and offenses under the military law. Death penalty should be abolished in sexual offenses and prostitution, offenses against property, offenses against freedom, offense related to corruption of officials, offenses related to causing harm to the public, terrorism, offenses relating to weapons, and guilty about drugs, it is therefore recommended for the appropriate penalty for these offenses is life imprisonment.

Abstract: งานวิจัยเรื่อง " การยกเลิกโทษประหารชีวิต: ศึกษากรณีความผิดที่เหมาะสม" มีวัตถุประสงค์เพื่อศึกษาถึงลักษณะของความผิดและลักษณะของอาชญากรที่เหมาะสมกับโทษประหารชีวิต ลักษณะของความผิดที่ยังคงมีบทระวางโทษถึงประหารชีวิตของประเทศไทย รูปแบบการกำหนดโทษประหารชีวิต และโทษที่เหมาะสมที่จะนำมาใช้แทนโทษประหารชีวิต หากประเทศไทยจะได้มีการยกเลิกโทษประหารชีวิต เพื่อหาแนวทางในการยกเลิกความผิดอาญาที่ยังคงมีบทระวางโทษถึงประหารชีวิต บางฐานความผิดที่ไม่มีความสอดคล้องหรือเหมาะสมกับปรัชญาของการลงโทษประหารชีวิต และกำหนดบทระวางโทษใหม่ให้เหมาะสมกับลักษณะความผิดและลักษณะของผู้กระทำความผิด ทั้งนี้เพื่อปฏิรูปกฎหมายโทษประหารชีวิตของไทยให้มีความสอดคล้อง และถูกต้องตามกฎหมายสิทธิมนุษยชนระหว่างประเทศ โดยเป็นการวิจัยแบบผสมผสานของการวิจัยเชิงปริมาณ และการวิจัยเชิงคุณภาพ โดยรวบรวมข้อมูลจากเอกสารและงานวิจัยที่เกี่ยวข้อง เพื่อนำมาใช้ในการวิเคราะห์ข้อมูลที่ต้องการศึกษา และเพื่อสร้างเครื่องมือหรือแบบสอบถาม เพื่อสอบถามความเห็นของบุคคลเกี่ยวข้องโดยตรงกับโทษประหารชีวิต อันได้แก่ พนักงานอัยการ และ ผู้พิพากษา การคัดเลือกกลุ่มตัวอย่างใช้วิธีการสุ่มแบบหลายขั้นตอน และการสุ่มตัวอย่างอย่างง่าย จากสำนักงานอัยการสูงสุด และ สำนักงานศาลยุติธรรม ภาค 1 ถึง ภาค 9 รวม 405 คน จากนั้นรวบรวมข้อมูลโดยใช้การสัมภาษณ์เชิงลึก กับบุคคลที่มีบทบาทและอิทธิพลในทางความคิดต่อคนในสังคมไทย เช่น นักวิชาการ นักสิทธิมนุษยชน บุคลากรทางศาสนา จำนวน 15 คน เฉพาะกลุ่มที่ผู้วิจัยเลือกแล้วเห็นว่าจะเป็นผู้ที่สามารถให้ข้อมูลที่เกี่ยวข้องและเป็นประโยชน์ต่อการวิจัยในครั้งนี้ สถิติที่ใช้ในการวิเคราะห์ผลการวิจัย ได้แก่ ร้อยละ และ ค่าเฉลี่ย ผลการวิจัยพบว่าความผิดที่เหมาะสมกับโทษประหารชีวิต ได้แก่ ความผิดต่อชีวิต ความผิดเกี่ยวกับความมั่นคง และความผิดตามประมวลกฎหมายอาญาทหาร ส่วนความผิดที่ควรยกเลิกโทษประหารชีวิต ได้แก่ ความผิดเกี่ยวกับเพศและการค้าประเวณี ความผิดเกี่ยวกับทรัพย์ ความผิดต่อเสรีภาพ ความผิดเกี่ยวกับการทุจริตต่อตำแหน่งหน้าที่ของเจ้าพนักงาน ความผิดเกี่ยวกับการก่อให้เกิดภยันตรายแก่ประชาชน ความผิดเกี่ยวกับการก่อการร้าย ความผิดเกี่ยวกับอาวุธ และ ความผิดเกี่ยวกับยาเสพติด
