Abstract: ธุรกิจโรงแรมเป็นธุรกิจที่มีความสำคัญในทางเศรษฐกิจและสังคม ดังนั้น รัฐจึงได้ตราพระราชบัญญัติ โรงแรม พ.ศ. 2547 ขึ้นเพื่อส่งเสริมและยกมาตรฐานการประกอบธุรกิจโรงแรม และกำหนดหลักเกณฑ์ใน การประกอบธุรกิจให้เหมาะสมกับสถานประกอบธุรกิจโรงแรมแต่ละประเภท วิทยานิพนธ์ฉบับนี้มี ความมุ่งหมายที่จะศึกษาและวิเคราะห์พระราชบัญญัติโรงแรม พ.ศ. 2547 เกี่ยวกับมาตรการทางกฎหมายใน การส่งเสริมและกำกับธุรกิจโรงแรม ว่ามีปัญหาและอุปสรรคในการบังคับใช้ประการใดบ้าง เพื่อหาแนวทาง ปรับปรุงแก้ไขต่อไป และจากการศึกษาพบว่าพระราชบัญญัติโรงแรม พ.ศ. 2547 มีบทบัญญัติบางประการ ที่ทำให้การส่งเสริมและกำกับธุรกิจโรงแรมไม่มีประสิทธิภาพ เช่น การเพิกถอนใบอนุญาตประกอบธุรกิจ โรงแรม กรณีผู้ประกอบธุรกิจเป็นห้างหุ้นส่วนหรือนิติบุคคลที่กฎหมายกำหนดหลักเกณฑ์ไว้ให้กระทำแทบ ไม่ได้ อีกทั้งกฎหมายฉบับนี้ได้ให้อำนาจฝ่ายบริหารในการวางหลักเกณฑ์การปฏิบัติ โดยการออกกฎ กระทรวงหรือปะกาศ หรือให้ตั้งอนุกรรมการเพื่อปฏิบัติหน้าที่ตามกฎหมาย แต่ฝ่ายบริหารยังไม่ได้ดำเนิน การออกกฎกระทรวง ประกาศ เพื่อให้การบังคับใช้กฎหมายบรรลุวัตถุประสงค์ และนอกจากนี้ยังมีกฎหมาย อื่นที่เกี่ยวข้องกับการประกอบธุรกิจโรงแรมยังไม่สอดคล้องกับพระราชบัญญัติโรงแรม พ.ศ. 2547 เช่น กฎกระทรวงตามกฎหมายควบคุมอาคาร เป็นต้น ดังนั้น จากผลการศึกษาผู้เขียนจึงเสนอว่าให้มีการดำเนิน การเกี่ยวกับมาตรการทางกฎหมายในการส่งเสริมและกำกับธุรกิจโรงแรม คือ ควรมีการปรับปรุงแก้ไข กฎเกณฑ์ในพระราชบัญญัติโรงแรม พ.ศ. 2547 ในกรณีการเพิกถอนใบอนุญาตประกอบธุรกิจโรงแรม ของผู้ประกอบธุรกิจโรงแรมที่เป็นห้างหุ้นส่วนหรือนิติบุคคลให้สามารถเพิกถอนใบอนุญาตเหมือนกับ ผู้ประกอบธุรกิจที่เป็นบุคคลธรรมดา และควรกำหนดหลักเกณฑ์ข้อยกเว้นสถานที่พักที่ไม่ใช่โรงแรมให้ ชัดเจน ในส่วนของการบังคับใช้กฎหมายสมควรที่ฝ่ายบริหารเร่งออกกฎกระทรวงและประกาศ เพื่อให้ การบังคับใช้กฎหมายบรรลุวัตถุประสงค์และควรศึกษาหาข้อมูลเพื่อออกกฎกระทรวงห้ามออกใบอนุญาต ประกอบธุรกิจโรงแรมโดยเร่งด่วน และควรแก้ไขปรับปรุงกฎหมายอื่นที่เกี่ยวข้องกับการประกอบธุรกิจ โรงแรมให้สอดคล้องกับพระราชบัญญัติโรงแรม พ.ศ. 2547

Abstract: Nowadays, Hotel business plays an important role in Thai's society and economy. Therefore, Thai government has found Hotel Act B.E. 2547 to promoet and support the standard as well as to supervise the hotel business in order to suit the variation of the hotel business. This thesis has an objective to study and analyze the legal measrues concerning the promotion and supervision of Hotel Act B.E. 2547. The study reviews the problem and obstacle to enforce the law which would lead to the revision in the future. From my research, I have found that Hotel Act B.E. 2547 relating to the promotion and the supervision of the hotel business is inefficient. For instance, the regulations relating to the license cancellation of the hotel entrepreneurs, who are juristic entities, are not efficient. According to Hotel Act B.E. 2547, the administration is authorized to regulate or to hold the sub commission to enforce the law. However, the law and regulations have not enacted to achieve the objectives of this Hotel Act. Besides, other laws relating to the hotel business do not support the enforcement of Hotel Act B.E. 2547 such as ministerial regulation of Building Control Act. Accordingly, I fully support the revision of the legal measures relating to the promotion and the supervision of the hotel business, namely the revision of Hotel Act B.E. 2547 relating to the license cancellation of the hotel entrepreneurs should be put in the as same standard and also the revision of the law relating to the exception for other accommodation business which is not clearly defined as the hotel business. Besides, new law and regulations should be push to fully enforce the hotel business. The study of the license procedure relating to the license denial should be done urgently to achieve the objectives of the hotel law. There should be the revision of other related law as well in order to support the enforcement of Hotel Act B.E. 2547.
