The development of legal aid in criminal case of Thailand

Abstract: Legal aid, in the scope of the assistance from the authority to appoint a lawyer for (an accused or) a defendant in criminal cases, has been in Thailand’s legal system since the promulgation of the Criminal Procedure Code. However, its existence in the Code does not fulfil the goal of the concept of the Rule of Law. Although Thailand has amended the Code for a number of times, the assistance does not help the intended people in a practical way. This researched touch upon the problems of Thailand’s legal system (on this issue) and attempted to find a way to develop improve its efficiency and effectiveness. The research adopted a qualitative methodology, comprised at documentary research, exploring the system in various countries. and an in depth interview with experts. The targets population of this study were a total of 10 people involved in providing legal aid. It was found in this study that the lack of effective legal aid in Thailand could be classified into 3 types (1) Eligibility problems (2) Appointment process and quality of lawyer problems and (3) Administration problems. The key factors in all the problems were, the lack of proper legislation to direct the roles and responsibility of involving authorities, as well as the lack of proper agency in charge of the scheme. This research proposed that the state should enact a specific legislation purposefully dealing with the scheme. This new legislation could be an amendment to the Act of Justice Fund 2015 to elevate the Fund to be an exclusive agency in charge of the scheme. Eligibility should be explicitly provided in the amendment. The Fund should have a system to control the quality of lawyers listed the Fund. Finally, in order to ensure quality service the internal audit and the external audit should be set up. Future research should explore the Courts’ power to ensure good service of appointedlawyers. and the right of defendants to choose lawyers .

Abstract: การให้ความช่วยเหลือทางกฎหมายในคดีอาญาโดยการตั้งทนายความให้แก่ผู้ต้องหาหรือจำเลยใน คดีอาญาได้ปรากฎอยู่ในระบบกฎหมายของไทยนับตั้งแต่มีการประกาศใช้ประมวลกฎหมายวีพิจารณาความอาญาอันเป็นการตอบสนองต่อแนวความคิดว่าด้วยหลักนิติรัฐ อย่างไรก็ตาม การปรากฎตัวของระบบการให้ความช่วยเหลือในประมวลดังกล่าวมิได้ทำให้การให้ความช่วยเหลือทางกฎหมายตอบสนองต่อเป้าหมายของแนวความคิดดังกล่าวอย่างแท้จริง แม้ประเทศไทยจะได้มีการแก้ไขประมวลกฎหมายวิธีพิจารณาความอาญาในประเด็นดังกล่าวนี้หลายครั้ง แต่สถานการณ์ในเรื่องนี้ก็ยังไม่สามารถตอบสนองต่อความต้องการของผู้ที่ประสงค์จะได้รับความช่วยเหลือในทางปฏิบัติอย่างแท้จริง การวิจัยฉบับนี้ได้สำรวจปัญหาในประเด็นนี้ที่เกิดขึ้นในระบบกฎหมายและพยายามที่จะค้นหาวิธีการในการพัฒนาระบบการให้ความช่วยเหลือนี้เพื่อให้เกิดประสิทธิภาพและประสิทธิผลอันจะนำไปสู่เป้าหมายของหลักนิติรัฐ การวิจับฉบับนี้ได้ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ ซึ่งประกอบไปด้วยการทบทวนวรรณกรรมเพื่อ เปรียบเทียบระบบการให้ความช่วยเหลือในประเทศต่างๆ ศึกษาปัญหาที่เกิดขึ้นในระบบกฎหมายของประเทศไทย และได้มีการสัมภาษณ์เชิงลึกผู้เชี่ยวชาญโดยใช้คำถามเปิด ผู้เชี่ยวชาญมีกลุ่มประชากรทั้งสิ้นจำนวน 10 คน ซึ่งเป็นผู้ที่เกี่ยวข้องกับการปฏิบัติในระบบการให้ความช่วยเหลือทางกฎหมายในคดีอาญา ผลการวิจัยพบว่า การขาดประสิทธิภาพในระบบการให้ความช่วยเหลือกฎหมายในคดีอาญาใน ประเทศไทยอาจแบ่งได้เป็น 3 ประเภท ได้แก่ (1) ปัญหาว่าด้วยเกณฑ์การให้ความช่วยเหลือ (2) ปัญหาเกี่ยวกับ วิธีการตั้งทนายความและคุณภาพของทนายความ และ (3) ปัญหาเกี่ยวกับการบริหารจัดการ การวิจัยพบว่า องค์ประกอบหลักที่ก่อให้เกิดปัญหาทั้งหลายเกิดจากการขาดกฎหมายที่เหมาะสมที่จะจัดบทบาทและความ รับผิดชอบโดยตรงของหน่วยงานที่เกี่ยวข้องต่างๆ ตลอดจนขาดองค์กรผู้มีอำนาจที่เหมาะสมที่จะรับผิดชอบใน ระบบนี้ทั้งระบบ รายงานวิจัยฉบับนี้เสนอให้รัฐออกกฎหมายเฉพาะที่จัดการระบบการให้ความช่วยเหลือทาง กฎหมายในคดีอาญา โดยกฎหมายใหม่นี้อาจเป็นการแก้ไขพระราชบัญญัติกองทุนยุติธรรม พ.ศ. 2558 เพื่อยกระดับให้กองทุนยุติธรรมเป็นองค์กรที่มีอำนาจเพียงผู้เดียวในการรับผิดชอบต่อระบบการให้ความช่วยเหลือทางกฎหมายกองทุนยุติธรรมนี้จะต้องสร้างระบบควบคุมคุณภาพของทนายความและเพื่อเป็นประกันต่อคุณภาพการให้บริการของกองทุนยุติธรรม จะต้องจัดให้มีการประเมินคุณภาพการให้ทั้งภายในและภายนอกองค์กรด้วย ปัญหาเกี่ยวกับอำนาจของศาลในการควบคุมคุณภาพการให้บริการของทนายความที่ได้รับการแต่งตั้งและสิทธิของจำเลยที่จะมีสิทธิเลือกทนายความเป็นคำถามวิจัยซึ่งควรจะมีการศึกษาต่อไปในอนาคต
