Abstract: The main objective of this study was to explore the policies and collaboration to prevent and suppress children and youth sexual exploitation, as well as investigate problems and setbacks that may obstruct the operation, The research also included learning how different countries collaborated to prevent and suppress such crimes in order to develop a model and the guidelines to formulate preventive system in view of the country becoming a members of the ASEAN Economic Community. The research employed both qualitative and quantitative methods. The quantitative data were collected from 229 officers comprised of police officers who had been working under the Anti-Human Trafficking Division, Royal Thai Police and officers of the Ministry of Social Development and Human Security in charge of prevention and suppression of sexual exploitation of children and youth from the central and regional divisions. The qualitative data, were collected from 20 experts in the prevention and suppression of sexual exploitation of children and youth. The findings from the study suggested that Thailand had consistently improved and developed the laws relevant to prevention and suppression of sexual exploitation of children and youth. The problems and setbacks that obstructed the operation and collaboration between countries still persisting, were; the drawbacks on policies and management planning, including the practitioners themselves. This research recommended that the 2. dimension International Model for the prevention of sexual exploitation of children and youth should be incorporated in the plan to eliminate such problem from the society, including the suppression through protection, assistance and returning the victim to society as the well as apprehension of the perpetrator to bring them to justice.

Abstract: การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษานโยบายและความร่วมมือในการป้องกันและปราบปรามคดีล่วงละเมิดทางเพศเด็กและเยาวชน สภาพปัญหาอุปสรรคในการดำเนินงานและความร่วมมือระหว่างประเทศในการป้องกันและปราบปรามการกระทำผิดในคดีล่วงละเมิดทางเพศเด็กและเยาวชน เพื่อนำไปสู่การพัฒนารูปแบบ รวมทั้งแนวทางการสร้างระบบความร่วมมือในการป้องกันและปราบปรามคดีล่วงละเมิดทางเพศเด็กและเยาวชนเพื่อให้สอดรับการก้าวเข้าสู่การเป็นประชาคมอาเซียน ซึ่งเป็นการวิจัยเชิงปริมาณและเชิงคุณภาพ โดยการศึกษาเชิง ปริมาณได้ทำการเก็บรวบรวมข้อมูลโดยการเก็บแบบสอบถามกับเจ้าหน้าที่ตำรวจสังกัดกองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับการค้ามนุษย์ สำนักงานตำรวจแห่งชาติ (บก.ปคม.) และเจ้าหน้าที่ศูนย์ปฏิบัติการ ป้องกันและปราบปรามการค้ามนุษย์ กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ที่ปฏิบัติงานเกี่ยวกับการป้องกันและปราบปรามการกระทำผิดในคดีล่วงละเมิดทางเพศเด็กและเยาวชนทั้งในส่วนกลางและส่วนภูมิภาค จำนวน 229 คน ส่วนการวิจัยเชิงคุณภาพ โดยใช้แบบสัมภาษณ์เชิงลึกเป็นเครื่องมือในการเก็บข้อมูล ผู้วิจัยได้คัดเลือกจากผู้เชี่ยวชาญด้านการป้องกันและปราบปรามการล่วงละเมิดทางเพศเด็กและเยาวชน จำนวน 20 คน ผลการศึกษาพบว่า ประเทศไทยได้มีการปรับปรุงและพัฒนากฎหมายที่เกี่ยวข้องกับการการป้องกันและปราบปรามคดีล่วงละเมิดทางเพศเด็กและเยาวชนมาโดยตลอด แต่ก็ยังคงสภาพปัญหา อุปสรรคในการดำเนินงานและความร่วมมือระหว่างประเทศในการป้องกันและปราบปรามคดีล่วงละเมิดทางเพศเด็กและเยาวชน ได้แก่ การกำหนดนโยบายและแผน การบริหารจัดการ และผู้ปฏิบัติงาน ดังนั้น รูปแบบระหว่างประเทศในการป้องกันและปราบปรามคดีล่วงละเมิดทางเพศเด็กและเยาวชนนั้น ควรประกอบด้วย 2 มิติดังนี้ มิติด้านการป้องกัน ซึ่งเป็นการวางแผนเพื่อไม่ให้คดีล่วงละเมิดทางเพศ เด็กและเยาวชนเกิดขึ้นในสังคม และมิติการปราบปราม โดยให้การคุ้มครอง ช่วยเหลือ และส่งผู้เสียหายกลับสู่สังคม รวมทั้งจับกุมผู้กระทำผิดเข้าสู่กระบวนการยุติธรรม
