Abstract:
Thailai adopts a parliamentary democratic regime of government with the King as Head of the State. The Constitution, has been determined the principle of the Rule of Law and Democracy as administration basic. A National assembly, as representatives of the people, has been consisted of the House of Representatives and the Senate in order to perform the duties of ligislation, controling the executives, approving important State Affairs, appointing constitutional supervcisory organizations and removing persons holding political positions and high ranking officials.The Senate, being an institution of the current Constitution, has been consisted of two hundred members elected by the people ; the term of senators is six years as from the election day. The Constitution has been provided the powers and duties of the Senate to consider, approve and reconsider laws, participating, under the provisions of the current Constitution, in National Assembly on important State Affairs, controling the executive, considering the selection, recommending, approving and appointing a person holding position under section 135 of the current Constitution, removing a preson holding political position and high rangking official, being committees andreprescutatives oIthe people. Some constitution in the past has been also provided the President of the Senate as the President of the National Assembly.Studying on the details within the scope of this thesis, five problems related the performance of the duties of the Senate have been found. The first problem has been concerned the appointment period of the senators which taken so long or several turns. The second problem has been concerned the impartialness to performe the duties of the President of the National Assembly. The third problem has been concerned the consideration of selectioti, appointment, recommendation or approval of a person to hold position under section 135 of the current Constitution. The fourth problem has been concerned the removal of a person holding political position and high ranking official. The fifth problem has been concerned the incompetence of senators to introducing bills and organic law bills. The foregoing problems have already been concluded and advised in the chapter 6 of this thesis.
