Abstract: เมื่อเจ้าของความลับทางการค้าของยาและเคมีภัณฑ์ทางการเกษตรที่ใช้สารเคมีชนิดใหม่ ขออนุญาตผลิต นำเข้า ส่งออกหรือขาย ซึ่งยาและเคมีภัณฑ์ทางการเกษตรดังกล่าว ซึ่งใน การขออนุญาตต้องมีการเสนอข้อมูลประกอบคำขอรับอนุญาตต่อหน่วยงานของรัฐและหากข้อมูล นั้นไม่ว่าทั้งหมดหรือบางส่วนเป็นความลับทางการค้าซึ่งมีลักษณะเป็นผลการทดสอบหรือข้อมูล อื่นใดที่การจัดทำ ค้นพบ หรือสร้างสรรค์ ต้องใช้ความพยายามอย่างมาก เมื่อผู้ขออนุญาตมี ความประสงค์ที่จะให้หน่วยงานของรัฐดูแลรักษาความลับทางการค้านั้น และผู้ขออนุญาตได้ขอ จดแจ้งให้หน่วยงานของรัฐดูแลรักษาความลับทางการค้าดังกล่าวด้วย หน่วยงานของรัฐก็ต้องมี หน้าที่ดูแลรักษาความลับทางการค้านั้นมิให้มีการเปิดเผย เอาไป หรือใช้ในเชิงพาณิชย์ที่ไม่ เป็นธรรม แต่มีปัญหาว่ามาตรการทางกฎหมายที่กำหนดให้หน่วยงานของรัฐดำเนินการในการ ดูแลรักษาความลับทางการค้ามิให้ถูกเปิดเผย เอาไป หรือใช้ในเชิงพาณิชย์ที่ไม่เป็นธรรมนั้น เป็นมาตรการที่มีขอบเขตการคุ้มครองของความลับทางการค้าที่เหมาะสมเพียงพอหรือไม่ เพียงใด สารนิพนธ์ฉบับนี้จึงมีวัตถุประสงค์ที่จะศึกษาวิจัยถึงบทบัญญัติทางกฎหมายของไทยที่ เกี่ยวกับการคุ้มครองความลับทางการค้า โดยเฉพาะในเรื่องการดูแลรักษาความลับทางการค้า โดยหน่วยงานของรัฐ ตามบทบัญญัติในพระราชบัญญัติความลับทางการค้า พ.ศ. 2545 และ กฎหมายอื่นที่เกี่ยวข้อง ทั้งนี้เพื่อแสดงให้เห็นถึงปัญหาของการดูแลรักษาความลับทางการค้า โดยหน่วยงานของรัฐและหาแนวทางในการแก้ไขปัญหาที่อาจจะเกิดขึ้นดังกล่าว โดยการ ศึกษาวิจัยครั้งนี้ได้นำฐานข้อมูลมาจากบทบัญญัติทางกฎหมาย คำพิพากษาของศาล บทความ และตำราทางวิชาการที่เกี่ยวข้องกับหลักเกณฑ์และมาตรการในการดูแลรักษาความลับทางการ ค้าในประเทศไทย จากการศึกษาพบว่าบทบัญญัติของกฎหมายไทยในการดูแลรักษาความลับทางการค้า โดยหน่วยงานของรัฐเป็นบทบัญญัติที่สอดคล้องกับความตกลงว่าด้วยสิทธิในทรัพย์สินทาง ปัญญาที่เกี่ยวกับการค้า (Agreement on Trade-Related Aspects of Intellectual Property Rights : TRIPs ) เนื่องจากเป็นการอนุวัตรการกฎหมายตามมาตรฐานขั้นต่ำ (Minimum Standard) ของความตกลงทริปส์ ข้อ 39 เพียงแต่มาตรการทางกฎหมายดังกล่าวยังไม่ เหมาะสม ชัดเจน เป็นธรรมและเป็นประโยชน์เพียงพอทั้งต่อผู้เป็นเจ้าของความลับ ทางการค้า เจ้าหน้าที่ของรัฐผู้มีหน้าที่ดูแลรักษาความลับทางการค้า และประเทศชาติ กล่าวคือ ยังขาดมาตรการการคุ้มครองความลับทางการค้าขณะที่ดำเนินการพิจารณาเอกสาร การขอขึ้นทะเบียนยาและเคมีภัณฑ์ทางการเกษตรที่ใช้สารเคมีชนิดใหม่ และขณะที่มีการ เปิดเผยหรือใช้ความลับทางการค้าโดยหน่วยงานของรัฐ อีกทั้งยังขาดหลักเกณฑ์และเงื่อนไขที่ เหมาะสมในการขอจดแจ้งให้ดูแลรักษาความลับทางการค้าต่อหน่วยงานของรัฐ รวมไปถึงบท กำหนดโทษที่สูงเกินไปสำหรับความผิดฐานเปิดเผยหรือใช้ความลับทางการค้าของผู้มีตำแหน่ง หน้าที่ในการดูแลรักษาความลับทางการค้าที่เกี่ยวกับยาและเคมีภัณฑ์ทางการเกษตรของผู้อื่นที่ เสนอข้อมูลนั้นประกอบคำขออนุญาต ผลิต นำเข้า ส่งออกหรือขายซึ่งยาหรือเคมีภัณฑ์ทาง การเกษตรที่ใช้สารเคมีชนิดใหม่ ดังนั้นสารนิพนธ์ฉบับนี้จึงได้เสนอแนะแนวทางให้มีการกำหนด มาตรการ หลักเกณฑ์ และเงื่อนไขในการคุ้มครองความลับทางการค้ากรณีการดูแลรักษา ความลับทางการค้าโดยหน่วยงานของรัฐให้มีความเหมาะสม ชัดเจน เป็นธรรมและเป็น ประโยชน์เพียงพอทั้งต่อผู้เป็นเจ้าของความลับทางการค้า เจ้าหน้าที่ของรัฐผู้มีหน้าที่ดูแลรักษา ความลับทางการค้า และประเทศชาติ

Abstract: When the Owner of the trade secret, in the matter of new drug and the agricultural chemical product, submit for the permission to produce, import, export and sell that products. The permission of the bureau or government will require full or part of the trade secret’ information, in the pattern of the test or any other information which acquired form the production, discovery or creativity, which had to required a lot of endeavor. When the owner desire to put their trade secret into the protection of the government and the owner already submit the motion for that protection, then the government will commit to protect their secret and make sure that it never be disclose, taken or use in commercial unjust way but there is a legal problem that the extension of the protection by government are sufficient enough to respond the need of the owner. This assertion, the researcher intent to study the Thailand trade secret act, especially in the matter of the government protection on trade secret according to the trade secret act B.E. 2545 and other relevant act. This process of study will demonstrate the problem on the government protection and figure the best solution to solve that problem. This assertion combine the database from act, decision, article and text book which concerned to the rule and code of the Thailand trade secret protection. From the study, we founded that Thailand government trade secret protection is cohere with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs). This because the minimum legal adaptation from the Trips Agreement section 39 but there still have some flaw in that adaptation, in the matter of inadequate, clearness, just and the mutual proficiency on the owner, governmental officer and country. This mean we still lack the protection in the documental examine process which the owner file the motion for drug and the agricultural chemical product and while been disclosed or used by the government bureau. Moreover we still lack the efficiency rule and term for the trade secret protection motion to the government bureau including the over punishment on the ground of disclose and use the trade secret by the officer, who responsible for the protection of the new drug and the agricultural chemical product which include the attach information the came along with the permission motion in production, import, export or sell the new drug and the agricultural chemical product. So this assertion will recommend that we should establish the adequate, clear and just code, rule and term in the protection of the trade secret by the government bureau which benefits owner, officer and country.
