Abstract:
In the past the elections were organized by the Ministry of Interior. There were a lot of irregularity in the election because the incumbent Minister of Interior was a member of the political party which was the government in power. An independent and politically impartial organization to supervise the election was conceived. The Constitution of the Kingdom of Thailand B.E. 2540 which aims at political reform, sets up an independent Board of Election with a concept that its members shall be persons of knowledge and ability and must not be biased against any political parties. They must be people of high integrity in the eye of the public which make them enjoy the independent in carrying out their duty and prevent them from reaping benefit for their colleagues and wipe off the corruption scandal.In reviewing the selection process of the members of the Board of Election under the Constitution, it was found that the spirit of the political reform had not been fulfilled as it allowed the political party to participate in the selection process of the Board of Election and the representative from the political was from the Government party alone as the constittition does not specifically provided that the representative from the political parties must be form both the Government and opposing parties. And in the nomination of the member of Board of Election from the Judiciary, a person outside the Judiciary was nominated in contravention to the provision of the Constitution which specifically provides that he or she must be a, judge. After a comparative study of the Board of Election abroad, it was found that some countries, specifically provide that one of its members must be an ex-judge. In India, though no specific qualification is provided; however, in practice an ex-judge is usually nominated as the Board of Election is considered an absolute organization vested with the legislative, executive and judicial powers.Furthermore, there are problems related to the confirmation of the nominees by the Senate, though ii is f the opinion that the persons nominated do not fit the spirit of the Constitution, the Senate must take further actions according the sequent of the selection process.It is therefore important to put emphasis on the selection process of the Board of Election. Since before the Board of Election can efficiently organize and election, it must begin with the caliber of the people pursuance to thespirit of political reform in the constitution which: sets up the Board of Electin so that the people will haye more thith and confidence in democratic govanmust as the. responsible organization for the election. Composes of people with ability impartiality and integrity.
