Abstract: วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาถึงอำนาจหน้าที่ของสภากรุงเทพมหานครศึกษากรณีการควบคุมการบริหารงานของกรุงเทพมหานคร ว่าอำนาจหน้าที่กังกล่าวจะมีขอบเขตกฎหมายมากน้อยเพียงใด และการใช้อำนาจหน้าที่ของสภากรุงเทพมหานคร บังเกิดผลอย่างมีประสิทธิภาพ และบรรลุวัตถุประสงค์ตามเจตนารมณ์ของการปกครองท้องถิ่นหรือไม่ ผลการศึกษาปรากฏว่าอำนาจหน้าที่ของสภากรุงเทพมหานครในการควบคุมการบริหารงานของกรุงเทพมหานครนั้น พระราชบัญญัติระเบียบบริหารราชการกรุงเทพมหานคร พ.ศ. 2528 ได้กำหนดมาตรการหลายประการด้วยกัน ได้แก่ การควบคุมโดยมาตรการข้อบังคับกรุงเทพมหานคร การแต่งตั้งคณะกรรมการวิสามัญและคณะกรรมการควบกรรมการวิสามัญ การให้ความเห็นชอบในการดำเนินกิจการบางอย่างของกรุงเทพมหานคร มาตรการการตั้งกระทู้ถาม การเสนอญัตติ การอภิปรายทั่วไปเพื่อให้ผู้ว่าราชการกรุงเทพมหานครชี้แจ้งข้อเท็จจริงและแสดงความคิดเห็นเกี่ยวกับการบริหารราชการของกรุงเทพมหานคร การควบคุมโดยมาตรการงบประมาณ และการควบคุมโดยมาตรการถอดถอนผู้ว่าราชการกรุงเทพมหานครออกจากตำแหน่ง แต่มาตรการต่างๆ โดยมาตรการถอดถอนผู้ว่าราชราชการกรุงเทพมหานครออกจากตำแหน่ง แต่มาตรการต่างๆ เหล่านี้ก็มีปัญหาข้อบกพร่อง เนื่องจากกฎหมายได้ให้อำนาจฝ่ายบริหารของกรุงเทพมหานครมากกว่า ทำให้สภากรุงเทพมหานครไม่สามารถควบคุมการบริหารงานของกรุงเทพมหานครได้อย่างมีประสิทธิภาพ ผู้เขียนจึงเสนอแนะแนวทางปรับปรุงแก้ไขอำนาจหน้าที่ของสภากรุงเทพมหานครในการควบคุมการบริหารงานของกรุงเทพมหานคร โดยพิจารณาเห็นว่าอำนาจหน้าที่ของสภากรุงเทพมหานครมีความเกี่ยวโยงกับโครงสร้างของกรุงเทพมหานครจนไม่สามารถแยกจากกันได้ การปรับปรุงอำนาจหน้าที่ของสภากรุงเทพมหานครจึงต้องทำการปรับปรุงโครงสร้างของกรุงเทพมหานครก่อน โดยให้มีการปกครองกรุงเทพมหานครเป็น 2 ระดับ ระดับบนคือรูปแบบกรุงเทพธนบุรีมหานครมีผู้ว่าการกรุงเทพธนบุรีมหานครและสภากรุงเทพธนบุรีมหานครมาจากการเลือกตั้ง ระดับล่างเรียกว่านครบาลมีจำนวน 9 นครบาล มีสภานครบาลมาจากการเลือกตั้งและสภาเลือกสมาชิกด้วยกันทำหน้าที่ฝ่ายบริหาร โดยสมาชิกสภานครบาลจะทำหน้าที่เป็นสมาชิกสภากรุงเทพธนบุรีมหานครด้วย สภาระดับบนคือสภากรุงเทพธนบุรีมหานครนั้น ให้มีสำนักงานเลขานุการสภากรุงเทพธนบุรีมหานคร ปฏิบัติงานและมีสายการบังคับบัญชาขึ้นตรงต่อปรานสภาฯปรับปรุงมาตรการควบคุมฝ่ายบริหารของสภาพบริหารกรุงเทพมหานคร ปรับปรุงการควบคุมโดยมาตรการข้อบังคับบัญญัติกรุงเทพมหานคร การเสนอว่าข้อบัญญัติของสมาชิกสภาต้องมีผู้รับรองอย่างน้อย 5 คน กรณีที่ร่างข้อบัญญัติใดสภาให้ความเห็นชอบแล้วแต่ผู้ว่าราชการกรุงเทพมหานครไม่เห็นด้วย สภาจะต้องมีมติยืนยันด้วยการลงคะแนนเสียงไม่น้อยกว่าสองในสามของสมาชิกทั้งหมด ปรับปรุงมาตรการตั้งกระทู้ถามโดยให้มีการตั้งกระทู้ถามด้วยวาจาในการประชุมครั้งนั้น ปรับปรุงมาตรการยื่นญัตติเกี่ยวกับกิจการงานของกรุเทพมหานครหรือญัตติอภิปรายทั่วไปเพื่อให้ฝ่ายบริหารชี้แจ้งหรือแสดงความคิดเห็น โดยให้มีการลงมติในเรื่องดังกล่าว แต่มตินั้นจะต้องไม่เป็นลักษณะของการให้ความไว้วางใจหรือไม่ให้ความไว้วางใจต่อฝ่ายบริหาร และฝ่ายบริหารจะต้องนำมติของที่ประชุมไปปฏิบัติหรืติดตามให้เป็นไปตามมติของสภา ปรับปรุงมาตรการควบคุมโดยวิธีวีการงบประมาณกรณีสภาไม่รับหลักการร่างข้อบัญญัติงบประมาณและมีการแต่งตั้งกรรมการร่วมเพื่อพิจารณา และสภาไม่เห็นด้วยกับการพิจารราของคณะกรรมการต้องใช้คะแนนเสียงไม่ต่ำกว่าสองในสามของสมาชิกจึงจะทำให้ร่างข้อบัญญัตินั้นตกไป ปรับปรุงการแปรญัตติของสมาชิกสภาโดยห้ามมิให้แปรญัตติเพิ่มเติมรายการหรือจำนวนในรายการ แต่อาจแปรญัตติได้ในทางลดหรือตัดทอนรายจ่าย ปรับปรุงมาตรการให้ความเห็นชอบของสภา ในกรณีที่ฝ่ายบริหารจะแต่งตั้งข้าราชการกรุงเทพมหานครระดับสูงเช่น เช่น ปลัดกรุงเทพมหานคร ต้อเสนอให้สภาให้ความเห็นชอบเพื่อลดปัญหาความขัดแย้งและให้การประสานงานระหว่างสภาและข้าราชการประจำของกรุงเทพมหานครเป็นอย่างราบรื่นมีประสิทธิภาพ สำหรับสภาระดับล่างคือสภานครบาล นอกจากะนำมาตรหารในการควบคุมฝ่ายบริหารดังเสนอไว้ข้างต้นมาถือปฏิบัติด้วยแล้ว สิ่งที่แตกต่างก็คือกรณีสภาไม่ให้ความเห็นชอบในหลักการของร่างข้อบัญญัติงบประมาณ จะมีผลทำให้ฝ่ายบริหารต้องออกจากตำแหน่งทันที ทั้งนี้ การกำหนดมาตรการควบคุมการบบริหารงานกรุงเทพมหานครใน 2 ระดับดังกล่าว โดยในระดับบนยังมีโครงสร้างเหมือนกับกรุงเทพมหานครปัจจุบัน และในระดับล่างเป็นการนำระบบรัฐสภามาใช้เพื่อเป็นการประสานแนวคิดทั้งฝ่ายที่ต้องการให้มีการเลือกตั้งผู้ว่าราชการกรุงเทพมหานคร ซึ่งจะทำให้การควบคุมการบริหารงานของกรุงเทพมหานครโดยสภากรงเทพมหานคร เป็นไปอย่างมีประสิทธิภาพและประสิทธิผล บรรลุตามเจตนารมณืของการปกครองท้องถิ่นอย่างแท้จริง

Abstract: The thesis based on the purpose of study in The Bangkok Metropolitan Assembly Authority in the Bangkok Metropolitan Administration's Control that how the said authority has any provision by and for the of the usage of the authority of the Bangkok Metropolitan Assembly has any problem or obstacle and whether attaining the objective of local administration.The result of the study in The Bangkok Metropolitan Assembly Authority in the Bangkok Metropolitan Administration's Control Bangkok Metropolitan Administration Regulations Act B.E. 2528 provides many criterion such as to control of Bangkok Metropolitan's Regulations, to appoint of ordinary directors committee and extraordinary directors committee, to opinion in some management of Bangkok Metropolitan, criterion of inquiry, to present of the motion, to general discuss for the governor of Bangkok Metropolitan explain the matter of fact and comment onBangkok Metropolis's administration, to control by criterion in budget and to controlby criterion in relieve the governor of Bangkok Metropolitan but al these criterions get problem of faults as for Bangkok Metropolis could. not control in Bangkok Metropolis Administration efficiency.We would like to advise for trending in readjustment of The Bangkok Metropolitan Assembly Authority in the Bangkok Metropolitan Administration's Control, by considering that The Bangkok Metropolitan Assembly Authority is link to the structure of Bangkok Metropolitan that cannot definitely be separated. The readjustment of the Bangkok Metropolitan Assembly Authority should be made prior to the structure of Bangkok Metropolitan. The administration shall be divided into 2 levels. First level is in the form that Bangkok-Thonburi Metropolitan has a governor of Bangkok Metropolitan and Bangkok-Thonburi Metropolitan Assembly shall come from the election. Second level call municipality with 9 branches, the Municipality Assembly come from the election and elect between the members to administrative officers. The Municipality member shall be engaged in Bangkok Thonburi Metropolitan Assembly as well.First level assembly namely Bangkok-Thonburi Metropolitan Assembly, shall provide Bangkok-Thonburi Metropolitan Assembly Secretariat Office perform and under control direct to the chairman of the assembly. To readjust the control by criterion of Bangkok Metropolitan's regulations. The presentation for draft of the provision of Assembly members require not less than 5 person to certify. In the case of any draft of the provision has been approved by the assembly but the governor of Bangkok Metropolitan not agree with, the assembly should has confirmation conclusion with voting not less than two in three of all the assembly members. Toreadjust of criterion for inquiry to be verbal inquiry in the meeting. To readjust criterion of presentation of the motion concerning activity of Bangkok Metropolitan or the motion of general discussion for the administrative explain or give the opinion by having conclusion in the said matter. The said conclusion should not be in the form of trust or untrust to the administrative. The administrative shall bring the conclusion of the meeting to perform or follow through the conclusion of the assembly. To readjust criterion control by budget system in the case of the assembly not accept criterion in draft provision budget and appoint co-directors for consideration. In case of the assembly not agree with the consideration of directors should have voting not less than two in three of assembly member in which the said draft provision shall be failed. To readjust the amendment of the motion of the assembly member by not allow to amend the motion in addition to the list or the quantity in the list but many amend the motion in reduce or deduct of the expenses. To readjust criterion for the approval of the assembly. In case of the administrative appoint the high position officer of Bangkok Metropolitan such as the assistance governor of Bangkok Metropolitan, should be approved by the assembly to reduce the probl?ni of the opposition and to cooperate between the assembly and permanent officers of Bangkok Metropolitan in smoothly and efficiency.For the second level assembly namely the municipality assembly, beside bringing criterion in control of administrative as the above to perform, the different is in case the assembly not agree with the criterion of draft of budge provision shall be effect to the administrative to relieve of this position immediately. However, the said criterion for control of Bangkok Metropolitan administration in 2 levels, in which the first level remain the structure same as the present Bangkok Metropolitan and the second level is to bring the parliament system. To coordinate to the idea of both partywherein one party need to have the election for governor of Bangkok Metropolitan and the another party need the parliament system to be used with Bangkok Metropolitan which shall obtain the control of Bangkok Metropolitan Administration by Bangkok Metropolitan Assembly efficiency and effective actually through the objective of local government.
